    can a colleague get you a copy of the company sick absence policy as a starting point? First off you need to see if they have followed the process they said they would.

    How have they disciminated against you though because you are gay?

    Well lets see... Ignoring my requests to be taken off for 'toilet' breaks, changing my days off at short notice, so I couldn't get to hospital visits or 'forgetting that I needed to be off during the course of the day so I could get to hospital and giving me a formal written warning for having Swine-Flu and being off work again as I 'refused' to work. And also making such comments like 'I'm not having a f**king faggot working here' (always handy to advise management that you are 'recording' the meeting as you can't rely on their notes or the support of the union ) & suggesting I wear surgical gloves when I'm driving. Constantly questioning both my GP and consultants after their own doctor agreed with their diagnosis. And finally, not permitting me to take medication during the course of my duty and 'failing to notify the company that I was taking prescribed medicines - again the company doctor was aware of the medication. I won't mention having a large box of condoms put in my locker when it is only management who have the key and failing to take action when i was 'threatened' by another colleague.

    Did I mention the 22 visits in a week, when any other employee was lucky to even hear from the company

    I'm also being discriminated against under the 'disability discrimination act' as I have long-term illnesses - and it was actually the Area Union Official that told me to claim both discrimination.

    this wasn't in your original post so how were we to know?
    also i have removed everything that does not relate to them discriminating against you because of your sexual orientation whilst you may feel the other bits unfair they have nothing to do with the fact your gay .

    The only sex discrimination allegations appear to be hearsay - have you any evidence at all (i.e. recordings of some of the comments and as already asked, did you report the condoms issue and the threat?)

    Ah - I see. What you are seeing is that "my face doesnt fit - because they dont like me. The reason they dont like me is I'm gay".

    I understand then why they might not be treating you in the same way then as they would treat others with the exact same circumstances (ie down to someone's personal prejudices).

    However - I have the feeling that the Sex Discrimination Act just refers to what sex one is, rather than to one's sexual orientation???

    I expect someone will soon come along and confirm how wide-ranging this Act is - or if there is some other Act that forbids discrimination on the grounds of sexual orientation.

    EDIT: The comments you make about bullying you have experienced - well..its obvious that was of an "anti gay" nature. Hmm....well there is some law somewhere about bullying at work - so I guess that is the relevant law you need to bring up here?

    It is understandable that a company would try and sack someone for so much sick leave (though I sympathise with anyone in this position obviously). You certainly sound pretty ill to me from what you say. They should have followed the proper process though and they should not bully you (whether on grounds of sexual orientation or anything else).

    Personally - I would pursue them legally for not following that proper process and it might be as well to bring in any proof you have of that bullying.
