I'm not sure, sorry. I'd check into that further, maybe with citizen's advice or the tax credits people. They can demand the money. I'm hoping they couldn't just dip into it as it's your own account and that (IMO) wouldnt be right.
I would also get tax credits to do a breakdown of when the repayment is for and insist that moneys owed to you for the period you were apart are not included. Although I'm assuming the whole £2000 wouldn't have been solely for April to July, again that seems a bit too much.August GC 10th - 10th : £200 / £70.61
NSD : 2/80 -
As the QC is now 23 there can not be an assesment in place only arrears. Think (probably wrong though) that assessable income for arrears is different to assessable income for calculation.
Surely there is something seriously wrong with the CSA being able to look into into NRPP personal bank account? (although if it is tax credits they can see the payments on their own systems so don't need to access partners account - certainly they have all my bank details etc)
OP as previously said by Shell you need to check who payment is from, what it is for and what time period it relates to. Ie if refund of overpaid tax from HMRC then that is your income and they can not touch it. If it is tax credits for a sole claim (the period you were single) then it is your income and they can not touch it. If it is tax credits for a joint claim (in both names no matter who's named 1st or whos account it goes into) then there is a possiblity they can go after it. Don't think they can just take it though.0
