Hi,
Can anyone advise me?? a few years ago I got into a slight bit of debt, around £4,000.00, I moved to Lanzarote in 2000 and then onto Gran Canaria, I came home back to england in 2004 During this time, the persons trying to recover the monies owed to them were sending letters to my mothers address but my mum was just sending them back saying not at this address, since I have come back to England, I have not heard anything nor have I or my mother received anything......until recentley, a few months ago, my mother got a letter from Lowell group asking for a sum of just under £4,000.00 that they are trying to recover for HSBC (a loan I got back in the late 90's) my mother still wrote on the letters not at this address and sent them back. A couple of weeks ago, they found my address and sent the same letter asking either for the full amount or to get in contact and arrange something. I have to this day not been in contact with them. can anyone help?? Since been back to UK I have a visa, current account and I am getting on my feet, theres no way I could pay this bill,I know its bad of me!! but please if anyone has any advice or can help, I woul very much appreciate this. I hope I have made sense.

If this debt has not been acknowledged for over 6 years then the debt is no longer enforceable - thay can not take you to court.0

Thanks for your help, do you know what my next action to take is, or do I just keep ignoring the letters, will this show on my credit score and can it be removed?asandwhen wrote:If this debt has not been acknowledged for over 6 years then the debt is no longer enforceable - thay can not take you to court.
Thanks again much appreciated0 -
This debt almost certainly comes under the 'Statute Barred' legislation, whereby if you have made no written contact to, or payment to, your creditor in the last 6 years, then the debt becomes 'statute barred' and is no longer enforceable. There is more information on the National Debtline (Link at top of page) and a template letter, which you can send to the creditor can be found here:

If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.
