I have had trouble with MBNA for a long time now.
They would put me over my credit limit on the card because of their interest rate! Then they would charge me an overlimit fee. If I miscalculated the payment (to try to avoid going overlimit) but I went over by £1, which did actually happen, they then charged me an overlimit fee, etc, etc. I couldn't keep track of them. It was just a vicious circle.
All these charges for going overlimit when it was the interest charge that sent it over, is it legal? Can I claim any of those fees back?
Since September I don't know what they have done. I missed my September payment, the first one I ever missed. I missed October 14th payment and will miss November. Going BR on 20th November and MBNA can take a running jump into a muddy pond!

hi there
MBNA are absolutely notorious on this site, they are nasty just let them go and jump in a big puddle when you go br.., but in the meantime don't talk to them and don't tell them you're about to go br..
when you go br... just give a rough idea of what the debt is, we had to do that with some of ours because we didn't know if they had put on whole amount of interest.Light Bulb Moment 1st January '06-£82,000

Thanks for the reply!
I have completed my online forms for BR and it is up-to-date to current cc statements, etc.
When you went bankrupt : Did the OR want you to produce any of your credit card receipts? I don't have any of mine except the last one for each.
I have to keep my bank statements because I am self-employed.
Did the OR give you a hard time over monies spent on one or more credit cards in the immediate months prior to your br?
An advisor told me that I should write to my creditors and tell them my court date for br but that it wouldn't stop them hounding me for money! Well, what is the point of telling them then?
Just three weeks to go now!
Any advice would be gratefully received. Thanks!0 -

I think that there is a lot of conflicting advice about whether you should inform your creditors about your impending br. I was advised against it and had been fending off calls from MBNA which were becoming more and more annoying - up to 6 times a day:mad:
Funnily enough - I have not received one phone call (famous last words) from them since my br. If they phone now I will just state my br date and number, tell them that the OR will contact them in due course, and remind them that they will be breaking the law if they try to contact me directly again.
I was, specifically, advised NOT to tell my bank until after br.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

Hi
Just a word about MBNA they cancelled my OH card about a year ago but never told us ?? I just saw a small wording on the bottom of a statement saying you card facility is suspended please do not use!! never had a word from them didn't bother to contact as it was up to the limit anyway! wonder if they will now we ve stopped making all payments after this month??
Once you ve gone BR you are not allowed to discuss anything with them the OR told me that you just give them your case reference and the telephone number for your OR if they ask anything else just say the OR has told me not to talk to you you must ring them! most don't say anything else after that. I recieved phone calls from most of my creditors but as I say after I gave them the reference they didn't call any more.

Thanks for the info - will keep it in mind.
Why not to tell the bank - was any reason given? I am very curious!0 -
MBNA were the reason I went bankrupt. Everyone else were more than willing to negotiate a payment plan. Trouble is that if one creditor continues being intransigent you just think "sod em all". I really feel sorry for the others coz I could have got through it. Atleast the calls have stopped now. Big step but good feeling now x0

I'm not sure either - possibly because I had two accounts with them - a very overdrawn business account, and a personal account that we needed to use for our normal living expenses. Perhaps, if I'd told them, they would have diverted funds (on the odd occasion that there were any) from the personal account to the buiness account.I am NOT, nor do I profess to be, a Qualified Debt Adviser. From your post:

Proud to be dealing with my debts"
Whats there to be proud about discharging your liabilities?0 -

That wasn't very nice.
I did try to do an IVA but it wasn't possible because I don't have any disposable income. I am disabled on DLA, IS and IB. I have no way of paying the money back, even though I want to. My illness came upon me suddenly, without warning. I am waiting for three ops. It is not a case of trying to get out of anything. I have barely enough money to live on to start with.
It is all well and good being judgmental but you should wait until you know the facts before you start criticising someone else. There but for the Grace of God.....................
the "proud to be dealing with my debts" is the dfw logo.
Do you have any idea what we go through comtemplating bankruptcy, never mind actually going through it?0 -
I just wanted to give a slightly different view of MBNA.
When I had my LBM, I had debts with say 15 creditors of whom MBNA were two (An MBNA credit card and an Abbey credit card).
MBNA were the quickest to contact me, they are the only credit cards on which I have been able to arrange 12m interest free periods (rather than 6), and they have not issued default notices on either card.
Where they were incredibly fierce was in negotiating a monthly amount. I have ended up paying them a higher percentage than my other creditors. However as my monthly payment is at a level below the interest I was paying to them, I see this as a good deal.
I have heard nothing from them since. I have standing orders for both cards in place and have paid as agreed each month.
I would recommend those who find themselves in similar situation to deal with MBNA early in the process as you may have to negotiate with them a bit. It is also worth trying to find a little space in you SOA to allow for this.
For what its worth, my worst experience thus far has been with Tesco personal finance who are still charging me interest four months after everyone else stopped and two months after they told me they would freeze it.
