    Wrong. There isn't constant information flow between the DWP and HMRC. If the system works perfectly, they will inform HMRC when the pension starts, and how much it is per week. Then they'll inform HMRC of the percentage increase each year for all pensioners. If HMRC haven't been told the initial amount, then the annual uprating will have no effect.

    OK, so if DWP don't tell HMRC every year, and the taxpayer hasn't told HMRC, then the mere fact that HMRC have suddenly "discovered" that the taxpayer was getting a state pension, and seem to have the right amount, that suggests that HMRC knew all along, and simply didn't act on information they already had. I think that it's likely that DWP did tell HMRC when the pension started and that HMRC didn't act on that information. If that's the case, then surely ESC A19 must apply. I think the OP would be crazy not to make an application under the ESC - if HMRC really didn't know from the outset, then that's fair enough, but I think, on balance of probabilities, this is just another case where they are at fault and the ESC will be given.
