Schedule of loss

What can be claimed for in a schedule of loss.
We have recieved paperwork from our solicitor which includes
basic award - gross weekly earnings exceed the statutory maxim.

loss of earnings - is claiming what he actually earned

injury to feeling - is there a set amount for this?

Can we put in a claim for pension? My husband was in a contributory pension scheme, he paid an amount and the company paid an amount into a pension scheme. Of course now that he has been sacked this isnt happening so the pension is just sitting there doing nothing. He is not old enough to claim it yet and he cannot get it paid early due to ilness because his pension company want to know if he will EVER be fit enough to work again. He was hoping to go back to work..but, getting a job in the current climate with a dismissal for sickness isnt going to be easy!

Is there anything else that we can claim of the schedule of loss?
Because my husbands boss kept telling him his job was safe and ready for him to return to when he was ready, my husband went into debt to buy a scooter for travelling to and from work. He would never have done this if he thought there was any chance of him not returning and he has now having to pay a loan payment even though he has no job. Even if we sell the scooter it will not make enough money to cover the loan and its not the right time of year to sell anyway!

    So just why are you putting in this claim...because he bought a scooter? Was he sacked or dismissed on health grounds?
  • He was dismissed on health grounds. He is covered by the disability discrimination act but no adjustments were offered by his company to enable him to return to his job. He is therefore goint to employment tribunal for unfair dismissal.

    You can only claim for contractual benefits (and injury to feelings since this is a discrimination claim) - so the pension yes, the scooter no. You cannot claim for debts you chose to take on - that is a bit like claiming that you wouldn't have taken on a mortgage if you knew that you were going to loose your job!

    There are guidelines - but not rules. These are:
    • The lower band - for less serious cases, for example where there has been an isolated incident of discrimination. The upper limit for this band is £6,000.
    • The middle band - for serious cases that do not justify an award in the highest band. The upper limit is £18,000
    • The upper band - For the most serious cases, for example where there has been a lengthy campaign of discrimination. The upper limit is £30,000.
    It is possible for a tribunal to exceed these guidelines - but exceptionally rare. It is up to the tribunal to interpret these - not you! So you can put whatever you want - but don't expect it!

    dont forget to claim for food heating and all the other extras he is using while being at home and not at work,,i know someone who got 10k for ciggerettes as they used to get duty free but could no longer get them..also for new clothes due to the weight gain by not working...i could tell you about a beer claim that was allowed but it is shocking..
    It is nice to see the value of your house going up'' Why ?
    Unless you are planning to sell up and not live anywhere, I can;t see the advantage.
    If you are planning to upsize the new house will cost more.
    If you are planning to downsize your new house will cost more than it should
    If you are trying to buy your first house its almost impossible.
