Outstanding Loan Repayment Problems

I am just trying to seek some guidance on where I stand with this issue.

History -

I had two Loans originally taken out some years ago with the Nationwide Building Society at the time I was in serious financial difficulty and ended up defaulting along with many other creditors at that time. I eventually went to a debt management agency who took over the management for a couple of years until I was able to face up to the challenge myself again. I have since then attempted (not always successfully) to manage my own affairs even though I still have substantial debts.

I have had several dealings with a company called Roxburghe and then Graham White Solicitors which if I have read up correctly appears to be a very poorly ran company.

Both the loans I had with Nationwide had been passed to them.

I went through several months of unemployment which meant that everything got hit again and then upon getting re-employed managed to start re-arranging new payments with creditors. My wife is presently unemployed as well so I have also taken on repayment of all of her debts. The current situation is that I am presently being hounded by Graham White Solicitors.

The Story so Far.....

The two loans one for approx £11k and the other for approx £7k.

I currently pay back monthly against the £11k loan through Roxburghe but when I went to setup an agreement for the £7k one things started going out of hand saying it had been passed to the Legal department. I spoke to the company and my wife on several occasions in relation to trying to sort things out. They apparently had taken the £7k claim to the County Courts to claim back and call judgement on it?

I had continued to respond and contact them and it was agreed over the phone with my wife a new repayment figure of £35 per month. She offered to make the payment that day on the phone the supposed account manager declined saying that she needed to wait for the confirmation in writing to come through then callback to make the payment. This is where the interesting part comes in!

I received a letter stating that a judgement had been decreed saying that I had to repay £200.00 per month. There is absolutely no way on this earth that I could afford this sum, so I contacted them again in reference to the fact they had agreed £35.00 with my wife on the phone. They stated that apparently this was never agreed and the fact that there had been a judgement on the account that I had to pay this new figure they were stating! I asked why they had agreed a figure with my wife that they had now changed it. They said they had not agreed a figure at which point I asked if they were accusing my wife of being a liar which he declined to answer directly. They apparently were within there right to claim the £200.00 as I had not responded to the County Court Papers in time and they had never received them back. I spoke to the County Court and tried to get a reference number which they could not provide me with as I have no original papers that I can find anywhere.

I then recontacted GWS and spoke to them again about the issue. (I recorded the next conversation). I have asked for copies of transcripts of previous calls and also did as they requested and contacted the Courts reference a variation after they gave me a reference number for the judgement. The court have since replied stating that there currently is no judgement on the above case and stated I should recontact the claimant reference this issue!

(Another strange part - we moved property last year and I received two letters from Nationwide Building Society stating the figures of the loans dated back to October this year dropped off by a neighbor where I used to live. I find this strange to say the least that the Nationwide still believe I am at an address I left over 12 months ago even though they have a Debt agency overseeing the accounts.)

I have once again spoken to GWS about the matter. They have never responded to the transcripts I requested though they amended the information of how I could attain transcript copies. They have now requested that I need to write to then directly and include a £10.00 cheque to be able to get them even though they previously said that one of their department would contact me directly over this request.

I also challenged them on the issue of there being no judgement in the courts even though I did as they stated and requested a variation for something that is not apparently in place. I have always been willing to make repayments but as it stands due to there lack of acceptance and unwillingness to assist with this matter all they suggest now is that they are entitled to ask for the £200.00 and also that they suggest I seek legal advice on the matter they will not explain the differences in statements or the reasons behind this approach of the judgement saying I must seek legal advice as they are completely within their rights to do so legally.

I am loathed to spend any more money trying to resolve this matter and wonder what my next move should be?

    have you thought of bankruptcy? do you not have a local cab that could look at your options, or phone national debt line..good luck
    It is nice to see the value of your house going up'' Why ?
    Unless you are planning to sell up and not live anywhere, I can;t see the advantage.
    If you are planning to upsize the new house will cost more.
    If you are planning to downsize your new house will cost more than it should
    If you are trying to buy your first house its almost impossible.
