return bed under 7 days distant selling regs

We want to return a bed under the above rules, the supplier has said we cannot, as their terms and conditions say when you have unpacked and used the bed albeit for for only 1 night then their T&C's take prescendent over this law............Are they right? cheers guys...

  • No-one's terms and conditions can take precedence over the law of the land. However, assuming you actually removed the plastic from the bed when you used it, then this may well be one of the few exceptions to the DSRs due to the intimate nature of the mattress.

    Jane is right. These exceptions also apply to items like underwear, swimwear, and piercings.

    Is there actually anything wrong with the mattress, or is it just that you don't like it?

    This is why it is best to find a retailer who gives a proper satisfaction guarantee, that allows you to unpack and sleep on the mattress.

    So what does a retailer who gives a proper satisfaction guarantee, "that allows you to unpack and sleep on the mattress" do with the mattress when the mattress is returned? Does the retailer stock the used mattress alongside new ones at the factory pending resale?

    I don't normally respond to you, but as you actually know the answer to that one because I told you personally, then I will answer for the sake of those that don't know.

    No reputable retailer would ever resell the items as new. As for what they actually do with them varies from retailer to retailer. However in general you will find that most wouldsell them as a tried out and returned item either on an auction site like ebay, or in a clearance section in their own store.

    The human body sweats nearly 0.5 pint of moisture a night, mattress usually soak this fliud up. It's not hygenic to send the item back.

    Also there are other bodily fliuds to think about as well, most mattresses get broken in on their 1st night, nudge nudge.

    Which is exactly why I always recommend a mattress protector.
  • A waterproof protector? A standard protector would not stop fluids getting into the mattress?

    So any mattress returned under a satisfaction guarantee could carry a disease even if used with a (non-water proof) mattress protector...

    Should carry a hefty discount from new meaning that it is very expensive for a retailer to accept a return...

    Unless you sweat buckets I would think a standard mattress protector would stop sweat and most other things from permeating a mattress.
