Personal Loan + BR

Hello all

I finally took the plunge last month and can only thank everyone on the board for the help and support I received during a very difficult decision.

I've since had something come up that I wonder if anyone has had experience with.
I took a personal loan to help fund the start of my business in 2004. When the business collapsed I was sure that I had PPI and wanted to claim on it as I started to sign on. The funder disagreed but could not produce a copy of my original application. Since going bankrupt they have managed to find the original agreement despite me requesting a copy for over 12 months.
What is very concerning is that the agreement asks if I want anyone elses income taken into consideration as part of the loan. There is a signature on there in my wifes name but its not her signature and her name is spelt wrongly.
Has this happened to anyone else and if so what did you do?

Hmm! interesting. I think a visit to the CAB might be in order or ring National Debtline.

To ask what though? My debt has gone into the BR, she's not on any of the credit files attached to this, the only thing we have in common is our mortgage

Well you will be fine as the debt is included in your BR but your DW will not be as she is not BR. Now they may try to claim she is responsible for the debt because she signed it BUT you have stated that the signature is not a true copy of her signature. You may find you get into a bit of a fight with them and it may be useful to know your rights.

Is that the case even if she is not named on the loan agreement?
