How common is charging order

Hi, still getting lots of grief from MBNA. Need to complain about the way they speak to me and even though I tell myself I still end up in tears. CCCS have put me on pro rata scheme and even though I have informed my creditors about the situation once they have received the letters I know the phone calls will come. Can any other company be as bad - I really am down and can't see no light or purpose. Sorry but this forum helps me so much - but the pain of all this is too much. When does it start to settle down and what are the chances of men at the door and/or charging orders - both have been threatened by above. They keep questionong me about what money was spent on especially as I had to use the card a few months ago to catch up payments with other creditors.

    Well, answering your question, not that common - 35,000 per year compared to bailiffs 350,000 on 2003 figures.

    However, you know that neither method of enforcement can be used unless you default on a county court judgement, and most creditors do not even apply for a CCJ - they just threaten to do so.

    So your concern is - how do I deal with the threatening phone calls? You need to devise a coping strategy. You could quote OFT debt collection guidance 2.8d: unfair business practice - contacting debtors directly and bypassing their appointed representatives. Then hang up.

    Different people different methods. Services such as choose to refuse and anonymous call barring can help. Ultimately the answer may be to change your phone number.

    And as for what you spent the money on, what does that matter?

    Evening tote alley stressed,sorry to hear about your bad time with MBNA,just wanted to offer you a bit of hope here.Although MBNA were the biggest pigs with us at the start of our DMP,they were actually the first to freeze interest and charges,they have passed our debt over to a DCA who have been nothing other than polite and understanding,so although they are bad now,it should settle down.At one point I had a call from the nasties at MBNA telling me that my children would be taken by social services because I was unfit to look after them because of debt :confused: ,told them to bog off :rolleyes:

  • I cant believe that companies like that would say stuff about taking your children

    its no wonder that people titer on the edge of suicide with people saying stuff like that

    it is hurrendous.

    Maybe I did the right thing in telling them all I would no longer speak on the phone!!

    i 2 have found mbna to be really bad ringing up and harrasing me first it was the indian call centers which were ringing my home everyday so i rang mbna and asked them to take my home phone no off there records you can ask them to just communicate via letter make sure if you do that you get through to someone english or irish the people in the foriegn call centers neva take ure number off it takes about 2 or 3 weeks for the number to be wiped off the system. Failing that just say you cant confirm ure dob name adress etc so due to data protection they must terminate the call!!!!!

    really tho dont let them grind you down i know i spent the money and im to blame but if mbna werent so good at charging us and putting ungodly amounts of interest on our accounts then we wouldnt be in the mess we are now just take the attitude their as much to blame and dont be worried!!!;)

  • It is important that if any of you receive calls from MBNA or other likeminded companies threatening the likelyhood of the removal of children from your custody, you inform your local MP.

    This statement is inaccurate as I have explained many times in the past.

    However to answer the original question - they are becoming more and more common particularly as homeowners these days will most likely have equity in their homes. However MBNA are not known for it so try not to worry about something that hasn't happened yet and might not ever happen.
