Couirt date forn reposession advice pls

hi

Have recieved notification from county court of a date set for repossession hearing. Have already left after the break up from my partner, she has only just left, we are both BR. Can anyone tell me what to expect on the day, already paying IPA so have no funds for court fee any advice would be great thanks.

    My experience (been same situation recently - apart from the breakup - i mean the repo of an empty propety - i'm also BR - get on with in Falze!!)

    Are you contesting the repo ? Does the OR have an interest in the property ?

    If your not and they're not - a simple letter to the court advising you are not contesting the repo and that you are BR will do. No need to attend if you dont want to. I didn't and could veiw all the goings on on-line

    The usernames and passwords should be in your court papers.

    You can see all documents submitted, attach you letter re contesting, see when the warrant is issued and enforced and finally when sucsessfull.

  • Thanks for the reply. so just a letter stating im BR and we are not contesting, with ref to OR they lodged a form to the land registry,so i believe they have intrest as if sold for the true value there would be some equity, can you tell me how long the process is after the court hearing, and what about handed keys in sorry for all the question just want to get it right.

  • Hopefully others will be along later with more advice but I would proceed cautiously - this is because if there is even a slight chance the house will not sell for as much as you think and then the house is in negative equity the banks are very sly and try and get people to sign a form which then means that you become liable for the shortfall. DO NOT SIGN ANYTHING WITHOUT GETTING ADVICE.

  • Deffo wont be signing anything have also been warned by the RBS few months back that they will sell at first offer and i will have to pay shortfall tried to explain i was BR but as usual they didnt listen, thanks for the advice, just as you say hoping i can get the advice of here, from someone has been through the process, but as advice already given have wrote a letter to the court explaining situation, with BR IPA Details and stateing i cant attend due to work/childcare commitments.

    Hi mate,

    We nevered returned our keys and ignored all letter and visits.

    They will change the locks when you are repo'd.

    I drive past old house everyday on the school run and a for sale sign is up !!!! (put up yesterday afternoon) Seem strange looking at our house on the estate agents website - A liittle surreal.

    Our court hearing was October'10, they gave us until 3rd NOv to get out and issued whe warrant on the 7th NOv.

    Fairly quick.

    Our OR had no interest in the property, so i cant advise there. Just keep the OR informed of what is happening would be my advise. Pepper their inbox everytime something happens, until they tell you they dont need to know.

    You can never provide too much info.

    Just a bit of info, I went to a repo hearing with a friend the other week and there was a duty solicitor from the Council advisory team there to give free advice to anyone who needed it for a hearing.
    Just in case you were thinking of attending.
