Scotcall Debt Collecting Services

Hi i'v had a bloke knocking on my door today from scotcall debt collecting services from 200 the balance has gone up to 380 they say, anyway what would you advice me to do about this? shall i pay them off, or not?

    Do you owe them money? lol

    That would be the decider to pay them or not.

    Ah, so they're not proper bailiffs appointed by the courts then? They have no right to turn up at your door without making an appointment first.

    When folk don't pay the debts with Credit resource solutions they get passed over to scot call, scot all, knock on the door to make an appointment and discuss things, this is usually after a lot of work has gone onto the debtor and the debtor has not made a reasonable offer or made any attempt to pay the debt. You'd be surprised on how flexible the law is.

    I today received a visit from one of your agents. Please be advised that Under OFT Rules you can only visit me at my home if you make an appointment and I have no wish to make such an appointment with you.

    There is an implied license under English Common Law for people to be able to visit me on my property without express permission; the postman and people asking for directions etc (Armstrong v Sheppard & Short Ltd, 1959, 2QB 384. Per Lord Eversham M.R.) Therefore take note that I revoke your license under Common Law for you, or your representatives to visit me at my property and, if you do so, you will be liable to damages for a tort of trespass and action will be taken, including but not limited to, police attendance.

    This should stop future visits from doorstep collectors. However, if it is your debt, you should either pay it off (if you are in a position to do so) or arrange some kind of payment plan to keep it from going any further. If this is a debt you've been ignoring and you continue to do so, they could take you to court and get a CCJ. Then it might be the bailiffs knocking at your door. If you're having problems paying off debt, post up an SoA and people will have a look and try to help you as much as possible.

    Scot call work within the guidelines, they advise debtors to make an appointment and then the first time they call at the door it's to make an appointment, so I'm led to believe.

    Debt collection visits
    2.11 Those visiting debtors must not act in an unclear or threatening manner.
    2.12 Examples of unfair practices are:
    a. not making the purpose of any proposed visit clear, for example, merely
    stating that collectors or field agents will call is not sufficient
    b. visiting a debtor when it is known they are vulnerable, for example, when
    a doctor's certificate has been provided stating that the debtor is ill
    c. continuing with a visit when it becomes apparent that the debtor is
    distressed or otherwise vulnerable, for example, it becomes apparent that
    the debtor has mental health problems
    d. entering a property uninvited
    e. not leaving a property when asked to
    f. visiting or threatening to visit debtors without prior agreement when the debt is deadlocked or disputed1
    g. not giving adequate notice of the time and date of a visit, visiting debtors, unless requested, at inappropriate locations such as work or hospital.

    As you can see, an appointment has to made in advance of any visit, the minute you tell them no appointment is wanted, they cannot call at your door as it breeches the guidelines.

    What's this debt supposed to be for, and why has it jumped up from 200 to 380?

    Hello Sir, I just happened to be in the area and wondered if I could make an appointment with you , for hmm say 5 mins time to discuss the matter of money that you owe.

    Tell him to FO otherwise you will report for trespass on your property.

    Law is not flexible.
    I all have learnt is from others on many sites.
    Seek legal help if unsure.
    Dont pay Private Parking tickets - they are mere invoices.
