my father passed away in september, the insurance payed of the mortgage, The mortgage was joint with my mother and they were married,
The morgtage company have now returned the deeds, am i right in saying we have to change the deeds into my mothers name only, theres was no will, am i right in saying it rightfully hers, does she just get intouch with the land registery? is there something she needs to do so the house is in her name?

I am sorry for your loss.
If the house was in joint names it automatically passes to your mother under the law, the fact that there is no will is irrelevant. But yes, you do need to register the property in her sole name. You should contact the Land Registry who will be able to advise you how to go about this. There should be no need to involve a solicitor.

Assuming it was joint tenancy (most properties are for exactly this reason - simply spend £4 obtaining the title register document from Land Registry) it is then a single form plus ID and death certificate to the land registry to remove your dad's name. Completely within the capabilities of any computer literate individual to process in their own right. My commiserations on the loss of your father.Hi, we’ve had to remove your signature.
