CRS chasing us for debt, please help

Hi, looking for help from you marvellous folk!
Short background story....OH got a car from Carcraft in August 2007, financed through Barclaycard. We have never missed a payment on this loan.
In January 2010 the car was in a bad accident, and eventually written off, again, during this time we never missed a payment on the loan.
The insurance company and the GAP paid off (we thought) all of the finance, except for a small shortfall, which, after hearing from Barclays about it we paid, or thought we had, it seems now that it was the case that the monthly payments were to contuinue, but Barckays did not state this, the letter just said we had to pay an amount, it did not say the amount of shortfall that this company is now asking for.
OH heard nothing more until now, (the last letter we had from Barclays was in June 2010).
Now we have a company called Credit Resource Solutions chasing OH for £1805.62, which they say is the debt oustanding on the finance.
The insurance and the gap combined paid a substantial amount to the finance company, and we had NO IDEA this was such a big shortfall until now.
OH has offered to pay per month the amount he was paying to Barclays (£155), but they have refused, saying he has to pay the full arrears amount, which is almost £900.
OH says no,I will pay what I was paying before, I have heard nothing from you until now, and anyway, surely the amount paid by the insurers cover any "arrears"?

They absolutely will not accept this offer of payment, and are threatening us with a "field agent" who will call at our home and enter our property.
Then they will take OH to court.
Please can we have some advice on what to say or do? We have already written to them, offering £155 per month, and also asking them to NOT contact us by telephone as it is several times a day, but they are refusing, and when OH speaks to them on the phone they are rude and threatening.

HELP!!! Please, I know there are some very wise and wondeful people here.

Thanks in advance.

Filed agents have no legal status and no legal rights whatsoever. They certainly cannot enter your home unless you invite them in.

There is a template letter refusing them the right to visit you at home. http://forums.moneysavingexpert.com/showpost.php?p=23635529&postcount=58
Have you sent the telephone harrasment template? http://forums.moneysavingexpert.com/showpost.php?p=11571485&postcount=4 if you have and they still haven't stopped then report them to all mentioned in the letter.

Have you started paying them the amount you have offered each month yet? If not then I would also start paying them that.

Edit - Have they ever actually given you a breakdown of the debt or any proof the amount they are collecting is correct? If not then you could also consider sending the prove it letter, asking for proof of the amount you owe and proof they hve a right to collect it. http://forums.moneysavingexpert.com/showpost.php?p=11570893&postcount=2

They're shouting off and making lame and border line illegal statements with rubbish like that.

Follow Tixy's advice above and please please don't be bullied or intimidated by these shysters. They will try their best to scare you but just ignore them or make suirrel noises down the phone until they get bored and hang up.

  • HI all, thanks for the advice, have already sent the harrassment letters, but they are blatantly ignoring that, its a text message they send to the house phone, and my oh's mobile..
One thing that we have considered is offering them a full and final settlement. would any of you advise that?
If so, how much, based on a debt of £1800?

    Many thanks, Again!!

Dont pay them anything and dispute the debt until they can offer you statements proving they are trying to collect money you actually
owe them and not trying to collect on incorrect paperwork.

The money could be late fees and extra charges that may not have been valid.

Is there a template letter anywhere to help us get this proof please??
