Hi
I know Im new and I keep asking Inane questions I promise i will TRY not to post any more! but I keep thinking of things whilst lying in bed.
As from my other posts You perhaps know I am trying to fill in bankruptcy forms for my OH
I have a dilemma
we have a car which after a quick scan through completed listings on ebay perhaps isn't worth what we thought (we thought about £3000 -£3500) but prob £2500 is more realistic
The car is in my name and really Im the only one who uses it for ferrying little un to school, sports clubs shopping etc etc (we are in a rural area) OH has a truck from work he uses.
My mum gave us some of the money towards the car (cos she was sick of me driving about in old/dangerous heaps!)
so
do I put the car down on his paperwork (cos obviously the running costs push out outgoings up) and stand the chance of losing it?
or Do I leave it off but then I worry they will investigate and see there was a car insurance payment coming out of his account?
Id love any of your thoughts??!
Also (Im being honest here!!) we have a holiday booked over xmas, I was very depressed for a while and some mad moment we decided to book as a load of friends were going, I managed to sell a load of stuff on ebay to pay for most of it and good ol mum did gave me some towards it, but we did put some of it on the credit card (when it didn't look like we could go) will this go against us with the O.R ?? will they take a dim view of it?
Oh what a mess!
Oh sorry one more question
there is about £200 on on card left do I withdraw it to put towards the court fees or is this a bit naughty?

First of all, I am completing forms for my own BR too.
For a realistic value of the car go to https://www.parkers.co.uk and use the trade-in value at the bottom of the list as your value. The Dealerships use this guide to value the car.
Also, please don't miss anything off your statement of affairs form. When the OR finds out, and they will, you will both be committing perjury.
The OR will understand that you need a car to ferry the children about, given that you live in the sticks.
I have read on another board that holidays are taken as an "asset". The OR would expect that all the activity on Ebay to pay for a holiday should have gone to pay your creditors. They may cancel the holiday for you and take the money to do just that. Sorry but I am being honest with you here.
If I were you I wouldn't take any money in cash from your credit card. However, you could use the cc to pay your food shopping, as a necessity.
Have you booked your court date yet?

Honest is fine! I already know the answers to most of it in my head! I know the money should have gone but its such a big ocean and that bucket of water wasn't gonna really make a difference.
We haven't got a court date will prob be Jan / Feb time as gotta save the court fees, get the forms filled out and get OH to do the rest. If I haven't moved out before then!
