02 Default notice

Hi All,
Im new to posting on this site but have been a lurker for a while now.
Just wondering if anyone can give me some advice. Ive recently checked my credit file & I was shocked to read that ive been given a default notice by 02.
I had a mobile contract with them & after many attempts to try & set up a direct debit no money was ever taken from my account. 02 never once wrote to me regarding this, is it legal to issue a default notice without telling you? Im now afraid its going to mess up my chances of getting a remortgage. Everything else on my credit file is good.
Any help would be appreciated.

Presumably you didn't get in touch with them either when you realised that they weren't taking the money?
Surely the only way to get out of this situation is to contact O2 to get arrangements in place and pay the oney which I am assuming from the tone of your post you do acknowledge that you owe.
Otherwise - things could come back to bite you later on in terms of mortgages or other credit applications.0 -
My main issue is the fact they have defaulted me without telling me they were going to do so. Is this legal? I have spoken to them today to ask for a copy of the original default, which they have refused to supply.0

Actually they can default you at a whim. This is an area that I think there needs to be greater regulation. I really think that there should be a procedure in place such as sending you written notification by recorded delivery i.e. proof that they contacted you to tell you. Also I think that there should be a minimum debt so if an admin error leaves you owing 2p you don't get defaulted for it...[strike]-£20,000[/strike] 0!0

How many months have you had the contract with them? Did they cancel your phone? The reason I ask is that my son has a contract with them (about 2 months now) and has a direct debit set up but they haven't taken anything out yet. He hasn't contracted them yet although I have nagged him about this!0

I originally had the contract for 12 mnts, in those 12 mnts I called them every month because the payment didnt go out, every month they promised me it was all in order & not to worry. Ive heard of other people that this has happened too. Ive taken legal advice today & have been advised to take it to ofcom & the financial service ombusman.0
