old employer still paying wages 2 months after employment ceased..

my dad lost his job back in september of this year, and on friday, my mum noticed that upon checking the bank account, it appears the company have paid him atleast once.
He was working one month in arrears, but he recieved all of his expenses back within one week of the employment starting. He received his first pay 5 weeks after beginning work.
My mum and dad are planning on handing the money back and been honest, but im curious whether if its the companies mistake whether they will realise they are paying him and if not whether they can legally keep it... My mum is waiting til next month to see if this happens again.
Has anyone ever had this happen before or got any advise.
They are totally set to ring the company to advise them, but are hanging off incase its legit and the company know about it???

  • no there is no legal case to keep the money, however they could arrange a payment plan to repay it back in a reasonable time period and the company would be barmy not to accept as it would cost time and money to go through court for the same result.

  • well, they havent spent the money and they wont, they are both too honest. they dont want to keep it if it is not legally their money. they have moved it into their savings account so it does not get spent. they wont want to pay it back in dribs and drabs they will pay it all back at once.
    I was just curious as to whether they cud keep it as it was the companies mistake. thanks for your reply x
  • I'd be on to the former employer to find out what's going on, to arrange to pay back anything that isn't due as soon as possible, and to stop it happening again. No point hanging on until next month.
