For the record - there is no law about a minimum period from redundancy to appointment of someone into the same position.I think I'm correct in saying that if your partner was made Redundant the employer would have to wait a period ( I think 3 months) before re-employing someone in this job, although I,m not 100% confident on that.
In fact, because situations can change at very short notice, they could advertise the day after the redundancy was effective and the new person could start straight away if they wanted. (Though this would raise questions about the reality of the redundancy situation, it could be justified by the award of a new contract, for instance.)0 -

For my sins I work in HR. Just had a quick read and I think the key points here are -
1) you don't have to sign a contract. Once you've received your first payslip there is an implicit signature on the contract.
2) she can't be made redundant if her job is being advertised. People aren't made redundant jobs are, people are then dismissed on the grounds of redundancy because their job no longer exists.
3) there is always the potential to be dismissed on the grounds of poor performance. To do this however the company would have to follow their internal processes, this should include a period of time where the employee is given a chance to improve after any issues have been discussed with them.
4) it's always a good idea to speak to ACAS (08457 47 47 47 Mon-Fri 0800-2000). Sometimes takes a while to get through!

Is any of her renumeration for the job based on performance or commision?
She was told informally by the store's manager that people higher up want her gone and have done for a while.
OK limited details on setup but sounds like highstreet chain with local store manager.
Where do these higher ups work?
Do they actualy know her?
My guess is that they don't have a clue about the local store and it is the manager that is using her as an excuse for the stores underperformance to save their own a***.
Now if this is the case then there is the posibility of a tactical move through these "higher ups" and HR(if there is any) by just asking them why they want you out and what package are they going to offer for you to go quietly.
If the place is never going to make money due to this flawed business model get out and work for somewhere that will make money.0 -

If there is a sale over a certain value she gets a small bonus for that on top of the basic wage. Yep sort of a high street chain. As far as I understand there is a store manager who almost pretty much works doing the same job as my GF but has more responsibility in the running of things etc for very little extra pay. The manager is relatively new and came only recently and I understand my GF was seen by her as a big help in showing her the ropes. I understand another of the employees seems quite universally disliked by store manager, area manager, and my gf as she has a tendency to disappear, take extra long lunch breaks and has a bit of an attitude - so I am somewhat perplexed why they seem to be targeting my GF too, other than the obvious sales figures. Then there is an area manager responsible for a small handful of stores who sets targets etc, and that area manager is probably getting lots of stick. Then I am not sure of the structure above that, presumably there is pressure on the area manager from above to meet targets etc - and she is in turn passing this pressure on to the store manager. Apparently the area manager has been making "jokes" such as "sack your staff" directed at the store manager. I guess you're right, but I also guess the managers like to all "hide" behind each other. They are unlikely to offer anything above that required by law in case of redundancy. They pretty much pay little above minimum wage. I get the impression part of the culture of the employer is to keep changing the staff in the hope that the grass is greener on the other side and that they get someone new to screw over, but it probably costs them more in the long run in training.
It has also been suggested the future of that particular store is in jeopardy anyway as it is a concession within another store and that store wants to end the contract as they are making too little money from it (presumably there's a percentage arrangement in place).getmore4less wrote: »If the place is never going to make money due to this flawed business model get out and work for somewhere that will make money.0 -

Yep I'm guessing it's a last ditch attempt (area manager - "I can make it work honestly please give me ANOTHER chance") and the ship has been sinking for far too long. It's a shame they're all too stupid to see the reality of the problem - the business model/prices/product, and instead blame it on the employees. Ultimate way to go bust, especially when your model means you can effectively run at a loss depending on what the customer buys. I'll bet there are some people working in the company who aren't too stupid to realise this, but are afraid to speak up.0 -
