Who pays council tax?

Options
I am leaving my rental on 31 December, however the tenancy technically continues until 23 January (and I've paid rent up to 23 January).

I intend to inform the council that the property is unoccupied from 31 December.

Who is then responsible for council tax? Do I have to cover it until 23 January even if I don't live there, or will LL need to pay from 1 January until they have a new tennant?

Just curious if the LL would have to pay as I don't want any of LL's extras costs being deducted from my deposit!

You are still liable for the bills up to 23rd January, however inform the council tax office regarding the state of the property, i.e furnished or unfurnished etc as there are discounts available depending on the status of the property. You should also take meter readings when you move out.

It looks like their trying to move another tenant in. This hopefully is good news for me, however if I'm not careful LL will move in new tenant, I'll continue paying until 23 January and he'll get double rent for most of the month! Doesn't seem right. Not quite sure how to play this.

If this is a real concern, just call around on some pretext, perhaps to collect post, to ascertain if someone has moved in.

  • if they get another tenant, then you should get a ret refund as a landlord is not allowed to collect 2 lots of rent for the same period.
