I rent a house, in joint names with my partner, and I have been threatened with bankruptcy over debts in my name. Can anyone let me know if the form below would actually stop baliffs from removing my personal possessions? It seems too good to be true to me :undecided
I, [name] of [address]
make the following declaration under the Statutory Declarations Act 1835
[All items contained within the property]/[All the items in the schedule below within the property...] at the above address and within it's boundaries, are owned by my partner Ms XXXXXXX]. [There are no items within the property or it's boundaries belonging to any other person.]
[Schedule
<list of items>]
I make this statement conscientiously believing the same to be true and by virtue of the provisions of the Statutory Declaration Act 1835.

I would think as long as your partner can prove they paid for everything in the property and you made no contributions
to anything then it may work. You paying for the bills and your partner buying the goods would count against you on
that point though as you had made contributions.
From what i have read when being made bankrupt they are only interested in high value goods.Censorship Reigns Supreme in Troll City...0 -
Bailiffs do not call if you go bankrupt.
The OR/trustee cannot claim items/assets that belong to someone else.
Virtually all normal household goods are automatically legally exempt from being claimed.
That letter is only of possible use if you have a CCJ against you and you know that bailiffs will call to try and enforce that.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB
