New job in notice period/London weighting?

So I've verbally informed my line manager that I'm leaving and handing in my notice.

I've not given in a resignation letter because I'm waiting for the written offer from the new post.

The industry I'm in does not pay holiday so we have to take our holidays during the notice period before the end of the contract. HR have confirmed that I could run my notice period from 10 December to 10 January.

So, the question is could I take up my new post on 4 January and thus give myself a few days holiday pay from the old job?

And following on from that, I am currently in London and presume that there is some London weighting to my salary but it's not stated how much it is or what percentage is added to it. The new manager then said that it would be about £2000 or so (in line with what other companies actually write out in their contracts etc).

The new post is not in London and have offered a slightly lower salary based on the years of experience. Should I ask HR at the old job how much the London weighting is and then work from there or not? I have asked the new manager for the same pay as we have had no increments since aug 09.

  • 1) You could do depending on your contract. If your on holiday and cannot be recalled or be expected to be contacted as well as not having any terms that prevent you working elsewhere you should be fine. If you have such clauses your probably still ok but run a slight risk.

    2) London Weightings are not automatic. If none is documented anywhere then I would take it to be you have no London weighting and that is your salary. Of course it may be the salary is higher based on location but that isnt the same as a direct london weighting. Ultimately I would tell them your current salary and take it from there and have an idea of what you want.

    Finally are you actually employed? It is illegal to not give staff a holiday entitlement.

    Yes, I have 25 days holiday a year but we don't have holiday pay. I have 15 days holiday (after the week of being snowed in!) and will need to be at work for at least a week to finalise and hand over things.

    I've worked hard (since the 'reasonable hours' in my contract includes working weekends) so I would like that extra week's pay.

    Thank you, I shall read through the contract again now I know what to look out for.

    This is illegal staff are entitled to 5.6 weeks holiday entitlement a year. If you work 5 days a week that is 28 days. This entitlement should be paid.

    I don't understand. If you have 25 days holiday you have 25 days paid holiday - not 25 days unpaid holiday. And it should be 28 not 25.

    I have often left one job, taken the remaining leave at the end and started the new job earlier than the official 'end' date - no matter what the contract said or didn't say....
    If you haven't got it - please don't flaunt it. TIA.

    we have 39 days holiday in total but we have mandatory closures at christmas and easter.

    Sorry, the 25 days is personal holidays.

    edit to add: Sorry!! I meant pay in lieu for the holidays that I haven't taken. The holidays are paid. But there will be outstanding days when I leave and I want to get paid for them. We are encouraged to take the remainder of holiday during the notice period but as my notice period is in December, most of the time off will be covered by the mandatory closures. So embarrassing to get this wrong, but I suppose it's because I never take time off. :rotfl:
