hi im anna,
ive been reading your blogs and can see we all seem to be in a similar pickle as they say.
ive received a letter from AIC stating they are acting on bealf of MBNa and that they have tried to contect me on several occations and have come to no agreement. they then say MBNA have instructed them, to receive full payment of my debt at £2500. they they go onto say nothing about comeing to my house only that they will be issuing me to go to court....
its this just a stupid threat letter or have they actually actted on this? im currenty going through a debt company who are arange for my CCA to be producted and hopefully write off my debts or come if possible. i know the debt copnay have contacted my creditors on my behalf but i find they seem to ignor their calls and letters. i live at home and am really worried about them knocking at my door as i do not want my parents knowing as they are elderly and should not have my worries to worry about.
any advice would be good.

            If you are using a debt company who claim to be able to write off debts then they can't, and you will pay to find that out.
 If the company you are going with charge you a fee then ditch them and contact one of the free advice organizations listed in the sticky at the top.Find out who you are and do that on purpose (thanks to Owain Wyn Jones quoting Dolly Parton)0

            I echo tealady, you should never pay for debt help. As for the letters, I would either ask for a CCA to prove they own the debt or keep it with any MBNA letters you have and got to the Citizen's Advice Bureau. They helped me sort out a debt management plan on all my debts and it's free.Not an expert, but I try and contribute and I'll always listen. Middle child of middle child parents. I drink way too much coffee.

            Anna - Please do NOT use a company to sort out your debt. They will charge you lots and you will get much better advice from here and another site (https://www.all-about-debt.co.uk) where there are friendly people who have your best interests at heart.
 THere is a link at the top of this thread with details of organisations who can provide good advice. The only people you should be talking to is CCCS, National Debtline, CAB or Christians Against Poverty.
 So, more thoughts on your debt -
 1. You need to go over to https://www.all-about-debt.co.uk and tell them about it. On this site you will find letters that you can send and things that you can do to sort it out.
 2. You need to look at your incomings and outgoings and put together a statement of affairs (SOA). There is another link at the top of this thread, but use the format from http://www.makesenseofcards.com/soacalc.html
 3. Keep posting here if it helps you, there are lots of people who have been in your situation and 'a problem shared is a problem halved'0

            Debt collection companies don't have any rights to do doorstep collections (if they do you can ask them to leave and if they refuse to do so you can call the police on them) however it doesn't sound like this company is threatening that but court action - which they can do since it sounds like you have made no effort to contact them or the original creditor regarding the money you owe.
 I assume this debt company is one of those that you are paying a fee to as they have promised you that 'all your debt will be magically written off'. If something sounds too good to be true then it generally is! What these companies do is write to the company and ask for a copy of your cca - you can do this yourself for a £1 charge - and IF the company doesn't have it or it isn't valid then you can use this as a defence if they take you to court and therefore they will struggle to get a ccj against you. This doesn't mean that the debt is written off or that they will just forget about it - you borrowed the money from them after all! They will still send you letters and ring you up, they will still pass to debt collectors, etc.
 As mentioned above you would do much better to contact one of the free debt charities who will able to offer you some advice without being focused on making a profit out of you. If you are absolutely set on going down the unenforceability route (and most people wouldn't recommend unless it was a last resort) then you need to contact the debt company you have been using asap and find out where they are up to with getting your cca before you get taken to court.0
