Hi
I am filling the forms out today for my OH bankruptcy and preparing everything so therefore I think there is little point to paying any more debts. but its possibly gonna be after xmas before I get the fees together so therefore how long after I stop paying will it take banks cards etc to realise there a problem and start phoning and threatening or people turning up at door?
oh and another question sorry How long between appearing at court and the phone call from the O.R?
thanks sorry for bugging you all again!

Chances are that no one will turn up at your door. I did not pay anything to my creditors for 6-8 months before I went BR and the worst that happened was phone calls. When they phoned I made a note of who it was and then only agreed to speak to them once a week the rest of the time I politely told them I was going to hang up.
You will get an appt to talk to the OR by phone or in person about 2 weeks after the bankruptcy order - but you may also have a brief interview on the day. Again either in person or over the phone. I saw my OR on the day for about 20 mins and about 2 hours, 2 weeks later. They just want to verify that you have not gambled or otherwise used the money badly. They also explain what you can and cannot do when bankrupt, such as be a company director or borrow over £500 without informing the lender of your bankruptcy.
Do not worry, it will be ok and you will not be the only one. The day i went to court, I dropped the papers off, the clerk told us to go as the judge would not want to see me and come back in 2 hours or so. There were 4 other people there at the same time. We were all at the OR office at the same time as well.
I owed £130k so try not to lose sleep over your debt and do not make any more payments now you have decided to go BR you will be better off saving the cash for your fee and Xmas.

Hi gg,
It seems to take about 4 weeks from when you take your papers to the court, until your BR hearing - although this will differ depending on the workload of your local court.
I was advised, by CAB, to stop paying (couldn't afford to pay anyway) my creditors immediately I received my BR petition.
As creditors have written to me I have been informing them of my BR date.

In my experience it's aboutb 2 months before they do anything at all. Then it'll be a polite letter then a couple of weeks later a "snottogram" arrives then a week or so after that the phone calls start. You have (I reckon) 3 months before things start to get sticky. Allow for the christmas holiday and I reckon you'll be in mid January before things get nasty...[strike]-£20,000[/strike] 0!0

Two months!
I informed my creditors by first class post that I was taking debt management advice ( I was going to do an IVA at that point).
The phone calls started within a week. The letters within 10 days. I have been bombarded with phone calls from morning til night Sunday to Sunday. The letters are about three per week from each Company. They have nothing better to do!
Up until I wrote to them all, I was not behind in my payments, had not defaulted on any payment, was up to date, etc. Then they start treating you like a criminal.
I stopped the phone calls. I did choose & refuse on the listed calls. I also did an anonymous caller block to stop the withheld numbers. The calls were just about driving me up the wall.
Myvesta said that the threats would still come, although they wouldn't do anything about it - just try to frighten me into paying them. Well, they can't get their hands on what I don't have!0 -
Thanks again all.
I was considering writing to them all but think Ill just leave it and carry on with the forms and saving the court fees. OH agreed tonight to sort this out (hope he ll stick to it ) he just worried about speaking on the phone to the O.R after wards as he don't know what they gonna ask him ? he says what can he say we spent the money on nothing really . Im now cancelling all the DD s in his account for the gas water etc and I ll pay them at post office till its all sorted. Kinda feels weird cos there a pile of bills here about £500 worth and not trying to sort them has kind of a nice feeling (I know thats bad) but Im allowed one day off! LOL

I know, they don't like us setting up IVAs at all do they? :rotfl:
But look at it another way. It takes until the next bill before they realise you haven't paid, then they send you a polite letter asking if this was an oversight. You leave it a week or ten days before you respond and you say that you'll sort it out. It's another 14 days before they realise that you've "forgotten" again then they phone you. You ask them to call you back at the end of the month. Therefore it's 2 months, granted it doesn't always work like that but if you are behaving out of the ordinary then it should.[strike]-£20,000[/strike] 0!0 -
So Doc are you saying I should respond to there letters? cos they all sort of gonna realise at the same time that he aint paying? its just while we save the fees up ? but will prob be jan / feb time before we get it together

I think Ive just got all panicky this afternoon . OH is not the best at talking to people (me included) and I don't know how he gonna handle the O.R
I know once its all done then it will be fine (cos i did it years ago! well had to but the CAB did all the stuff for me and it was all over in about 3weeks)
i think Im putting it off a bit cos we are supposed to be going away over xmas.
i kinda want to get it done before we go but then but then I don't want it all to come to a head before we do so I think wait till new year! ?? !
Ive told OH this is his last chance to sort himself (us) out other wise Im gone I could just pack up and leave but I don't wanna disrupt out 9yr old unless I have to.
I just think OH will fall apart on the phone and Im one of these people who feels guilty just looking at a policeman so I always think worst and think ooo they gonna find something and send us to prison. cos we can't really explain where all the money gone! again!
sorry Im rambling now ! You hold it all in so long every day in front of everyone then put me on a keyboard and it all comes out! LOL
thanks
