company name vs trading name registration

    With the name I have found, I will use that as a sole trader and then if that business works out okay I will then create a dormant limited company for it so that no one can steal the name etc.

    Company names are very important - it simply isn't possible to have two companies ofthe same name!

    Actually they can as long as they're not Ltd or a PLC. There are plenty of examples on Watchdog where they get some !!!!! paving company and state that "Company X is not related to Company Y of the same name in Lundinium. If they can't trade under the same name, perhaps you'd care to explain all the non-related chip shops, hairdressers and pubs throughout the land with the same names but in different places?
  • SarEI is correct!! I just went to Companies House, 21 Bloomsbury Street, London and two people on the desk both told me that you cannot have two companies using the same ltd name in the same country......because you cannot confuse the public.....was their explanation.

    Furthermore, they told me that even if I registered a name as a self-employed person someone can rob it, even one year later for example, by registering that same name as a ltd company and in that case I would have to cease trading as a self-employed person with the same name (bar the ltd not being on my business name) as that ltd company. Hence they gave me a IN01 form and ticked Private Limited By Shares for me (so I can register my business name as a dormant company......AA02 Form for the accounts).
