Not been paid because work is closed?

    Hi again,

    I've looked through my partners contract again and it states the following:

    Short Time Working and Lay Off:
    The Company reserves the right to introduce short time working or a period of temporary layoff where this is necessary to avoid redundancies or where there is a shortage of work.

    I've looked at the ACAS PDF regarding this (acas.org.uk/CHttpHandler.ashx?id=314&p=0) and it says that she doesn't have to be paid if there is a specific term stating so and I was just wondering whether this is specific enough as it doesn't mention pay?

    Hi,

    Thank you for taking the time to help me.

    Can they invoke this clause after they have closed the business? E.g. tell staff not to come into work day after day for 3 days and then on say the next day they are open (so Monday) say they are invoking this clause?

    Your partner has been instructed to go to the workplace to turn customers away and so your partners employer acknowledges that there is no shortage of work. Clearly, the business anticipates that work, i nthe form of customers, will be available.
