Discrimination at work (long story)

  • I would suggest that working in a bar is not similar to selling houses etc (which is what they think you did). I can see why they would be concerned with the latter one but not the former and choose to take action. Think of reasons like money laundering along with the risk of the company name being damaged. Unless the bar is a well known brothel I dont see how it could be damaging.

    But it was proven that the house had been owned for a few years and he was selling it. I cannt see a problem with that. The boss sounds like a jealous fool and shouldnt be allowed to get away with treating people how he likes just because he has a problem with them.

    I am struggling to see what claim you could bring before an employment tribunal in these circumstances (unless you are thinking of resigning and claiming constructive dismissal which - in my view - would be unlikely to succeed).
    I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.
  • If he has written down (e.g. in an email) that you are homophobic, racist etc and shown or sent it to any other person you could sue him for defamation and the onus would be on him to prove that his allegations are true. If you have copies of any such material show it to a solicitor.

    Correct but lets get a perspective here. No big accountancy firm has held a proper discliplinary involving HR and senior management based on accusations of one employee with no evidence. I strongly suspect the OP isnt telling us something.

    Does he have a history of selling "holiday homes". Even if you buy a holiday home every few years and wait for it to appreciate its arguably a business transaction of sort although most would turn it round to an investment.

    Therefore he set up an investigatory meeting and didn't follow protocol by not having HR present so he asked me leading questions and put words in my mouth. He asked if I had an outside business interest and i told him no i don't - he knew about my holiday home as he has been there but yet still decided to sent me to disciplinary. At disciplinary his old friend from the company did the hearing and i told them i wasn't happy with this and acas say that if i feel its biased the meeting should be adjourned but it wasn't. Acas also state that if I claim i'm being discriminated against which i did and can prove with the minutes then the meeting should be adjourned but it wasn't. They were all there to get rid of me that day but thankfully as i have evidence against others they just knew they couldn't sack me as I stood up for myself.

    How can I possibly work for someone like this that has twisted things, clearly doesn't like me, clearly wants rid of me and so on. I have tried to raise a grievance but HR won't hear it!!!!!!!! I am following protocol, they are not. What other option do I have other than to resign? If so I will take them to court for constructive dismissal.

    the boss is jealous - I have an expensive car due to an inheritance and he doesn't like this one bit as he likes to be the 'top dog'. Hence me having the nice holiday home too, but i'm still a hard worker and chartered accountant.
  • mr redundant, no I have no history of selling holiday homes and I have told them to check with the land registry and my solicitor if they don't believe me. There is nothing that I am not telling you. I have never sold a home in my life other than this holiday home - yes, i'll prob make a profit but so what? I think as it's value was high that's what wound him up.

    I wonder how much bullying there is and how much of it is that you have a thing about your boss that you let influence you.

    It sounds to me like you dont like him and are determined to cause problems.

    The more you the post the more it sounds to me that there is a lot more to this story.
  • ok thanks mr redundant. its not me that decided to take me to a tribunal to try to get rid of me nor am i determined to cause problems. this whole thing started out with him googling me and him choosing to have an investigatory meeting and him sending me to a disciplinary etc.
