unpaid sick/overtime

Hi i'm new to the forum and need some advice. I have called in sick, my company does not pay for sick days so i am losing eight hours pay. I have been told that if i do any overtime then i will not be paid for it at the usual rate of time and half. instead i will have to do the first eight hours at normal rate.
Can my company do this?

    i assume this is to stop people taking a day off and then recouping in OT
    i would think they could given they dont have to pay time and a half for overtime by law.
    i assume this is written in your contract?
  • Thanks for your reply. It does state in my contract that i get time and half for any overtime.
  • As far as i know, it does not state anything about me losing the time and half due to sick leave, i'm going to double check now.

    I would say it is right though, if you are contracted to say 38 hours and don't get sick pay and take a day off so lose 8 hours i don't see how they could pay you 30 hours then 8 at time and a half, otherwise everyone would be taking sick days then picking uo OT on other days to bump up their income.
  • IME Overtime is usually only paid once you have worked over full time hours. So if a part timer works extra hours, they will only get paid usual hourly rate until they hit full time, then it goes to overtime rate.

    Same principle. Also in my experience places won't let you work overtime if you have been off sick during that week anyway.

    I know in royal mail the part timers get paid standard rate till they hit 40 hours
    then they get the increased rate for a further 10 hours (same as FTers)

    Well I know of people who "work" in the local dockyard. They have the Wednesday, Thursday and Friday off sick, and then sonehow manage to come in on the Saturday morning for overtime.
  • We are contracted for 37 hours ,if you have a day off sick and have already worked some overtime they will use that at standard rate to make up the 37 hours

    Overtime means in additional to normal working hours, and you have taken a sick day so have not completed your normal working hours.

    Your contract says you get time and half for overtime, and you will; when you have completed your normal working hours.

    Legal, reasonable and common practice.
