Incorrect salary deductions - Who is responsible

Hi there

I recently noticed that my company medical insurance was on the wrong plan - Family instead of Single Parent. When I questioned this with the HR department they told me that the onus was on me to check if the details were correct and they are not responsible for the error so won't refund me.

The issue I have is that the incorrect information has also been passed on to the Inland Revenue so I have been paying too much tax.

Can someone please tell me if my HR department are right or if I can challenge their stance.

  • I had a similar problem regarding car benefit and HR are correct in that it is your responsibility to notice which plan you are on.

    However I can't see why you can't get a rebate but someone with more knowledge will have to let you know if and why.

    You should be able to get a tax rebate from the HMRC if you have been paying too much tax.
    For information on how to reclaim tax overpaid via PAYE see the HMRC website:
    http://www.hmrc.gov.uk/incometax/overpaid-thro-job.htm

    Basically you call your tax office (see your payslip for which one) and they go through the information with you and either send a notice to your employer to change your tax code in order to get your tax repaid through your salary or if they need more information they'll let you know what they need.

    I don't see how HR can give you the money back from the health insurance as presumably that gets paid to the health insurance company.
