Hi

I'm having some trouble with these incompetent fools.

My grandad died in September, and my grandma gave me £1000 for sorting everything out. I put this toward my debts.

I phoned CapQuest up to pay off the £787.18 that I owed them. They said that they would accept £595 as a final settlement, which I paid to them, and they then told me to cancel the direct debit, which I did. This left my account with a balance of £192.18

Today, they sent me a text message saying to get in touch with them, and about 45 minutes later they phoned me. They said that my account was overdue with a balance of just over £400. I asked them how the hell they worked that out and they said that the direct debit was declined and that I was charged a fee because of that.

I then told them that I'd paid £595 for a final settlement a few weeks ago. They checked, and then apologised.

However, I don't trust these idiots not to keep phoning up and racking up the amount that I supposedly owe them.

How would I go about getting this to stop. I was thinking a Subject Access Request to get the bit where it specifically states that the payment was a final settlement, but I'm not sure where to go from there.

Any pointers?

So, you didn't get agreement to the "final settlement" in writing?

Unfortunately not. Now realising how stupid this is, which is why the first thing I'm thinking of doing is a SAR to pull the records, maybe even recorded phone calls where they offer it to me

If they checked and confirmed that it was settled, then they must have internal records that show this and would need to be supplied via a SAR.

If you get any further hassle then it may be worth it. Make sure that you specify that you require the settlement details in any request.

If it was me, then I would wait and see if they now shut up first. But depends on how badly you want to be proactive?

Sounds like an idea to me. It's just under a month until the date when my payment would go out, so I'll wait till then. If nothing, then I shall forget about it, but if they phone up again I'll kick off on them

    Thanks :)

Any way you can get the whole transaction reversed?

I doubt it. Was on my debit card nearly a month ago

  • Been at my boyfriends house for a few days, and come home to find a letter from "HL Legal" (aka CrapQuest) waiting for me, spouting out that my direct debit has been cancelled and that if I fail to make arrangements to pay blah de blah. It was dated the same day that I got the text and phone call.

The letter gave the balance as £172.18, which is £20 lower than what it would be if I hadn't have settled with them.

Phoned them up about it (apologised to my grandmother in advance about the bad language, although I didn't get that angry with them). They said they weren't sure why I go it as my account was showing up as cleared, balance £0.

Just done the SAR. Going to send it off Monday recorded delivery.

  • If the letter is dated the same day as the phone call, it sounds like someone forgot to cancel the DD at their end, so it bounced when you cancelled it at your end. When it bounced, they phoned you and sent a standard letter out. They checked at the time and apologised, and have now confirmed that they show a zero balance, so its almost certainly nothing to worry about.
  • Today I received a reply to the SAR, telling me that they are gathering the informationl

At the top of the letter, it lists my account no, and balance which it shows as - £0.00 :D:D:D:D:D:D

    Sorted :)

Thanks for your help guys :)
