Employer not paid tax & NI contributions can i get a new job?

Don't know if anyone can help but I really need advice:

I've just found out that my employer has not paid tax or NI contributions since the company was formed 2 years ago.

The company is about to go under because it owes a lot of money to HMRC.

I need to find a new job, but how do I prove I've been working, I can't provide a p45 because there is no legal record with HMRC of me working, plus, because the company is about to go bust, I can't provide a reference as there will not be anyone here within the next couple of months.

What can I do to get a new job? To all intents and purposes it appears that I have a 2 year gap in my CV that I now can't prove was actually spent working.

Any help will be much appreciated.

  • There are several issues here:

    it is not essential to give a P45 to a new employer: some P45s are very out of date for people who stop working, do not claim JSA then go back to work after a long break. Some people have another part-time job which they have not left, so have no P45 to give. A P46 is used instead. You do need to be careful though that you get tax deducted at the correct rate in the new job.

    As for the current employer, you really should have got payslips with the deductions shown: it is not your problem if they did not pass it on to HMRC. Did you get anything? Did you get paid holidays, sick leave and other employee benefits? If you were treated as self-employed, you could put that on your CV.
