Leaving employment/Signed off sick/Paid upfront. HELP!

Hiya,

I've been off work since the 15th November and got signed off sick on Monday till the 1st.

The thing is my job is paid half in arrears and half upfront (ie. I got paid on the 15th). I already had a huge chunk taken out because they had overpaid me the month before (as I bought Christmas presents). However I'll be leaving the job on the 6th. So I'll only technically have worked for half the money that I have earned.

Any idea how they will work this out? I don't know when I will be paid from my new job (btw the reason I am off sick/going to a new job is because my current job caused me to be ill).

My weekly "wage" before tax is £317.31 or £63.46 per day and I know SSP is £75.19 per week. If I'm off does that mean I'll owe them about £910 (including the overpayment from the month before)? On top of that I also have to pay them back £300 on top for my bike scheme.

Am I going to end up owing them £1200!? I've already got enough debt and I could really do without this!

NOTE: They do offer company sick pay but I'm not sure what the allowances are. In the last twelve months, previous to this, I've had about 10 days off due to various things. None of these required a doctors certificate. Any advice would be great!

    I guess first and foremost you need to find out what the allowances are to ascertain if you have been over paid or not?

    Is the bike you refer to unde the cycle to work scheme?

    If an employee leaves or is made redundant from their employment during the hire period they are obliged to pay the remaining salary sacrifice amount in full from net pay i.e. without any tax exemptions.

    So you could end up paying more than 300.00

    Every Company has different rules about how they sort out over/ underpayments and different entitlements to Company sick pay. You really need to find out what sick pay you will get.

    Unless the Company pays you sick pay at full pay (which is possible) they will have to reclaim money from you for 15-30 November (12 days assuming you work Mon-Fri), then you would get normal pay 1-6 December (4 days).

    If you only get SSP then you'll owe them 8 x £63.46 = £507.68, minus @ £150 (the SSP). So about £357.

    You will owe them £357, plus last months overpayment plus what ever is due under the bike scheme (if this is what it is). If this would make your life very hard, be proactive and tell/ ask your Manager you know you owe it but could you pay it back over 6 months. If they are reasonable they may allow this rather than pursuing the debt.
