Terms and conditions
Art 1: ORGANISING COMPANY
Air France, public limited company with a capital of 1.901.231.625 Euros, registered under number 420 495 178 in the Bobigny « Registre du commerce et des soci!t!s », and with its registered office at 45, rue de Paris 95747 ROISSY CDG CEDEX – France, is organising for its own benefit a free game on Internet with no obligation to purchase that will take place from 19 November 2010 at 00:00 to 05 March 2011 at 23:59 inclusively (UK time).
Art 2: PARTICIPATION
This game is open to any private individual of adult age (over 18) residing in the the United Kingdom; excluding any person involved, whether directly or indirectly in the organisation of the competition or employees of the organising companies and their families (same surname, same address). Participation in the game implies full acceptance of these Game Rules and General Information currently in effect on the Internet, and of laws and regulations applicable to free games and competitions. Failure to comply with the Game Rules shall entail cancellation of the competition entry and any associated applications or sponsorship.
Art 3: ANNOUNCEMENT
This game may be entered between 19 November 2010 and 05 March 2011, on http://www.airfrance.co.uk/GB/en/local/guidevoyageur/destination/Aberdeen-to-Orlando.htm Registration or entries received after 05 March 2011 will be disqualified. It may also be advertised in other advertising media such as advertising banners on partner sites. All personal data will be retained by Air France under the terms of Article 10 of these Game Rules. All entrants are asked to subscribe voluntarily to receive future Air France (and Air France partners) offers and promotions. Entrants can unsubscribe upon the receipt of the first Air France communication providing offers or promotions or at any time after that and will be advised of this in those later communications. Entry of this competition is not conditional on becoming or remaining a subscriber.
Art 4: CONDITIONS
In order to play, participants need only correctly fill out the registration form and play the game available on http://www.airfrance.co.uk: the participant has to find the right location on the world map of cities symbolising Air France international airports.
The sender can sponsor his/her friends at the end of the game. In order to satisfy participation and accounting conditions, the email addresses of the participant’s friends communicated to the organiser must be valid and different from one another. The participant furthermore commits to having obtained the accord of their holders for this communication, its use by the organiser to send emails, in the name of and for the account of the participant, and to inviting the friend(s) one time only to participate in the game. With this commitment, the participant rids the organiser of any responsibility for the communication of these email addresses.
Art 5: NAMING OF WINNER
The winner will be chosen through a draw amongst valid participants one month after the closing of the contest.The draw will be conducted electronically via the game database. The name of the winner shall not be given either by telephone or letter. The winner will be individually notified by email after the drawing.
Art 6: AUTHORISED ENTRIES
The participant must fill out all fields in the form required for his/her registration and click on the “OK” button. Incomplete or incorrect registration will not be considered and will render participation null and void. Only one participant per household may play: (same surname and/or same address and/or same e-mail address). In the event of more than one entry per household, only the first entry will be taken as valid. Anyone registering with multiple different e-mail addresses will be disqualified. Any attempt at fraud on the part of a participant will render null and void any participation forms sent from that household.
Art 7: PRIZE
The prize consists of 1 pair of return tickets on Air France from Aberdeen Airport to Orlando in Economy Class. Valid from 07 June 2011 to 07 June 2012. Prize winner flight ticket conditions: Non-changeable Non-refundable Non-transferable Valid on Air France flights from Aberdeen Airport via Paris Charles de Gaulle. Non-transferable Air France will pay for the airport taxes The winner and companion must travel on the same dates/routing for the whole journey The prize cannot be transferred to another person. Travel dates are subject to availability of prize winner booking class
Art 8: ATTRIBUTION OF PRIZES
The winner will be notified of his/her prize by e-mail. If the winner does not respond before 05 June 2011, he/she will be considered to have waived his/her prize, and no new winner will be named for this prize. Winner must comply with the Game Rules. If the winner fails to meet the criteria of the present Game Rules, his/her prize will remain the property of Air France. Prizes may not be returned or exchanged against their value in cash or against any other prize, or transferred to third parties. However, in the event of force majeure or if circumstances require, Air France reserves the right at any time to replace the prize offered with another prize of equivalent value. No challenge or claim of any kind will be accepted with regard to the prize. Winner undertake to make no claim in liability against Air France with respect to the prize, or its delivery, condition, attributes or any consequence entailed by the possession or use of the prize.
Art 9: CHANGES TO GAME DATES
Air France accepts no liability if, in the event of force majeure or of events beyond its control, should it cancel the present game, reduce it, extend it, postpone it or modify its conditions. In all cases, Air France reserves the right to extend the period of participation, to prepare a new list or an additional list of the dates and times of the winning periods. Any modification to the rules shall be subject to a complementary filing with the court bailiff whose name is given at article 15.
Art 10: USE OF PERSONAL DATA
The personal data collected in connection with the Competition shall be processed in accordance with the French law of 6 January 1978 known as the “Informatique et Libertes” [Information Technology and Civil Liberties] law as amended by the Law of 6 August 2004. Competition entrants are hereby informed that the personal data concerning them in connection with this Competition are required for due processing of their competition entries. Such personal data may also be communicated to third parties. All Competition entrants have, pursuant to Article 27 of the aforementioned law, a right of access to and correction of errors in the data relating to them. Any application for access, correction or challenge to such data must be sent by postal mail to Air France GBI (LON.PE), Plesman House, Cains Lane, Bedfont, Middlesex, TW14 9RL. Transmission to third parties of the personal data collected by Air France is subject to the prior express agreement of the participant. Winners give their permission to Air France to use as such for advertising purposes their family names and first names without restriction or reservation and without this conferring on them, any entitlement to any remuneration, rights or benefit whatsoever other than the award of their prizes. However, where any winner does not wish use to be made of his or her family name and first name in this context, he or she may request application of such prohibition by letter sent to Air France, doing so before 05 June 2011.
Art 11: LIABILITY
Air France shall not be liable in the event of any dysfunction of the Internet that prevents access to the game or its proper progression. In particular, Air France shall not be held liable for any external acts of malice. Although Air France makes every effort to provide users with available and verified information and/or tools, it may not be held liable for mistakes (in particular mistakes in display on the game sites, erroneous sending of e-mails to participants), for lack of available information, and/or the presence of viruses on the site. Participation in this game implies awareness and acceptance of the characteristics and limitations of the Internet, lack of protection of certain data against possible misappropriation or pirating, and risks of contamination by any viruses circulating over the system. It is each participant’s responsibility to take all appropriate measures to protect his/her own data and/or software stored on his/her computer and telephone equipment against any attack. Connection to the site and participation in the game by any person is done entirely under that person’s responsibility. In addition, Air France is not liable in the case of: Telephone connection problems Hardware or software problems Destruction of information supplied by participants for a reason not attributable to Air France Errors of human or electrical origin Disturbances that might affect the proper progression of the game or the dysfunction of the automated drawing process Air France is not liable for the consequences of any delays, losses, thefts or damage to regular or electronic mail that are not attributable to it. Addressees must make claims directly to the companies having been responsible for handling said mail. Air France may not be held liable for the physical inability of the winners to board or travel on the aircraft or to go to a foreign country because of the irregularity of their travel documents (lack of passport, expired passport, etc.….). In all cases, in which the proper administrative and/or technical operation of the Competition is negatively affected by a virus, computer bug, unauthorised human action or any other cause for which Air France is not responsible, Air France reserves the right to interrupt operation of the Competition. Any fraud or non-compliance with the Game Rules may give rise to exclusion from the game: if necessary, Air France reserves the right to take legal action against it.
