I need help

I am being forced to pay a mortgage I do not want.
I split up with the ex 2 years ago, since then he has actively kept the asking price above its market valve, why? because he does not want me moving out of my mothers house with our child.
This is not me guessing the reason, I know this is the reason.

I cant afford a solicitor anymore, although I have been offered legal aid, I am just worried when and if I do come into a bit of money, then there will be a huge bill shoved in front of my face, plus, can anyone really force him?

I feel this is not fair anymore, living a cramped room with my daughter is not good. Why on earth has come about that he is in control of all this?
I cant lower the house without his permission, I cant accept any offer without his permission.................. but he can waste over 500 of my money every month. its absoulte !!!!.

    Is the property jointly owned (joint tenants or tenants in common ?)
    What proportion of the mortgage are you paying each month ?
    Is your ex living in the house ?
    If so, is he paying you rent ?

    It is jointly owned as in joint tennents
    I am paying half of the mortgage, so is he plus all the other bills, insurances etc
    No he is not in the house, it has been empty for 2 years now
    And we were not married

    I know I have to pay as it is my responsiblity as well as his but he is using this against me in a bad way, it is just not fair anymore and the fact nothing can stop him doing this is frustrating as hell.
  • I have a friend in a similar position, she is going to court in Jan to ask the judge to order a sale on the property, but enforcing it could be a problem.

    You could just not pay, as my ex has done, see my thread but you would still be liable for the shortfall unless you declare bankruptcy.

    Maybe its time for you to start playing hardball back. For example, if the mortgage doesnt get paid, it damages his credit rating as well as yours. Tell him that you wont pay your half of the mortgage any more and will ensure that the lender has all his contact details unless he backs down. That doesnt mean you will but it may change his mind when he realises the consequences of either having to pay all of it himself or get into arrears and suffer many years of not being able to get credit again.

    I am rather scared of the whole process of not paying etc. I have said I am refusing to pay, but he does not care...... I dont understand why he is even still paying if he does not care? He is a hard one to understand for sure.
  • Can you use the legal aid to apply for a Court Order of Sale and ask to be in charge of the sale because of his reluctance to sell at a reasonable price?
