New job but no reference?

Hi all, my OH has been conditionally offered a new job subject to references.
He has been with his current employer for 6 years and told me that they won't give him a reference as they don't give anyone them!

What happens there then? Can his current employer get away with not providing him with a reference and potentially costing him his new job? Surely thats not right!!

eta: do they have to provide factual info like work dates, timekeeping etc?

Comments

  • They are not obliged to do anything, although most employers will provide dates of employment - has he asked them for this? Has he asked the new employer what they are prepared to accept?

Hes not asked them yet. The letter just came today from the new employers and he was like 'i'll not get a reference' and I couldn't believe they'd be allowed to do that!

I think he'll just need to pass on their details to new employer and see what happens...

The short answer is yes. They are under no obligation to provide a reference.

Does he have a written statement of terms and conditions of employment (a contract)? This will give his start date, and his P45 will give his end date, so at least he can prove his dates of employment.

Apart from that, does he have someone else who can give him a reference? Even a character reference?

Hopefully the new employer will be willing to work round this.
I'm a retired employment solicitor. Hopefully some of my comments might be useful, but they are only my opinion and not intended as legal advice.

I bloody hope so! I'll be raging if this stops him getting the job! His employer before his current one doesn't exsist anymore so I'm not sure where he could get another reference...

His current employer are so crap! Completly disorganised and disfunctional and hes been under threat of redundancy twice in 18 mths.

get him to ask his supervisor if he would give a 'personal' reference

also if you know someone with a company that would write asking for a ref and see what happens
