Help with invoice paid

I had a great chat with the people from CCCS and I am now putting my finishing touches to the plan they gave me. I am not yet on a DMP, they have advised me what to do short term and it will be reviewed later.

Anyway, I had an overdraft facility with a bank and it was running at £1,000 of the £3,000 limit. I managed to complete a project for a client, one of the last I managed and that was already in progress when I spoke to CSSS. The money came through direct to said bank account which meant I cleared the overdraft but left me without a penny of it in theory!

I say in theory because I was advised by CSSS to setup a new bank account, forget my last account and move all essential DDs and SOs to the new account. I was to pay mortgage, utilities etc and creditors were last on the list, this was to include overdrafts. I couldn't change the payment by BACS in time so it hit the account on the day I was advised by CCCS - in fact I thought the client was not going to pay me because they had defaulted on others. I guess I was fortunate that the money went in.

The bank are unaware of the plan so I have a cheeky question. Can I remove the money and pay it into my new account now? Is that wrong or will they discover what has happened and somehow get the money back?

It's a real dilemma for me and something I have never had to do anything like this before so I have no idea what I can or cannot do. I guess it would classed as immoral but I can live with immoral after being shafted by the bank on many occasions. I cannot live with illegal hence my request for help on here.

To summarise the advice from CCCS, they told me to forget my current bank account, arrange for all DD and SO payments to be paid from my new account. I was to pay essential bills like gas, electric, council tax etc and creditors would be paid a token gesture each month whilst I tried to improve my circumstances.

What can I do that will not land me in hot water?

    I am just entering a DMP with CCCS and now have a new bank account which i am in the process of transfering all dd's etc.
    We have requested wages to be paid into new bank account for this month and fingers crossed should make it.
    However if we don't:eek: i intend to draw this money out as i need it to pay my priority bills.
    We are always in our overdaft and at the mo my bank is not aware of a problem but wrongly or rightly i wouldn't hesitate to move it.

    We were told to take everything out to pay for essentials so we did. You can always pay it back under your own terms but you won't get it back from them once the ball is rolling.

  • take the money out if you can, if you need it for bills etc then you need it, when i set my dmp up with cccs a couple of years ago it was too late to get wages paid into my new acc so they advised me to take every penny of my pay out of the halifax and let the rest be dealt with on my dmp, but you need to do it before the bank find out you are putting your od into a dmp or they wont let you take the money out at all!
