Help with Loan charges

Hi there

please can you help with what we should do next

my girlfriend took out a loan with Welcome Finance a couple of years ago for approx £1200. Approx 1 year ago she topped up this with an extra £150 borrowed

Shes not been good with the payments though they have got their money after chasing her up. They now claim she owes £2500 though everytime she requests a statement of whats shes paid/when/what the interest rate is now/what charges have been incurred they promise to send a basic statement but nothing arrives, and they say they cant send a full history.

surely they must send all info on their system, can any charges be claimed back, shes got to pay £100 pound tomorrow to prevent further action, it all seems a bit mickey mouse and she wants to now start getting on top of it.

any advise would be much appreciated

    Have a look on here, they have all the letters you need to get them to send your papers etsc. If you word it right, they legally have to send you everything. http://www.consumeractiongroup.co.uk/

    thank you for your replys. So it should in theory work the same as the banks then, first step, send them a letter insisting on a statement with a £10 cheque?

    If I am correct, statements are not covered by the Data Protection Act, and they are therefore not entitled to charge for this information. They are however obliged to provide you with a statement and a breakdown of their charges.

    Your g/f should write to them explaining that the charges they have applied to her account are not enforceable, as punitive fines are not recoverable in a court of law, and that she requires a breakdown of the charges applied to her account within 14 days.

    A correctly worded letter, along those lines, which you can find on the site https://www.consumeractiongroup.com will I am sure get the ball rolling. You will need to register but it is worth the effort.

    Read well throught the site, if necessary, ask the same question on CAG, I think the proceedure is slightly different to the bank, but not 100% sure.
