    Have you got your particulars? they should list all the F&F that will be left in the house, that you should have signed and returned a copy of to the solicitors...
  • If the vendor agreed you could have the white goods all the way through the sale then its their word, there is nothing legally binding. You can threaten to pull out of the sale and i very much doubt that the vendor will let you do this for the sake of the white goods.

    I was an estate agent for 8 year and if a buyer done this i would have done everything in my power to stop the buyer pulling out - the estate agents wont get their fee! Speak to your agent and advise you can quite easilly pull out and will do so if the vendor doesnt agree. If they wont tie them in with the sale, offer to buy them - but only offer a very small amount!!
  • can't understand how they have got to nearly exchanging without the F&F being done and agreed - our solicitor gets it to us really quickly.
  • We've had the list back for a while now and have been questioning it with the Estate Agents, however they have been telling us that they cant get hold of the vendor because when the survey came back it said that the boiler was very old so we also wanted to get someone in to service it but again the Estate Agents just said that they couldnt get hold of them to arrange it.

    Frustrating to say the least!

  • goober00 - tell your solicitor not to exchange contracts tomorrow until your issues are resolved ...... the vendor will soon make themselves available then.
  • Have a look at the Fixtures and Fittings document that your solicitor sent to you ( usually sent in the initial paperwork). If all these items are listed in this document what the seller is doing is breach of contract. My first port of call would be your solicitor and ask him to raise an enquiry with their solicitor clarifying the situation. Also- most definitiely call the Estate Agent and explain the situation and threaten that you will pull out. They most definitely wont want to lose the commision. If you exchange contracts and the items are not listed on the F&F form - I am afraid that you do not have a leg to stand on.
  • Refuse to exchange...stick to your guns. If they insist on removal, or have already done so, ask for a cash adjustment.

    The price they accepted was on the basis as advertised, unless they have something in writing to the contrary.
    Act in haste, repent at leisure.
