Hi guys I was wondering if you could give me some advice today at work a colleague of mine was forced to work just over 14 hours with only 30min brake for lunch at the13 hour mark I mention to a senior sales member (supervisor) that he should maybe have a world with the area manger about her going home. As im pretty sure unless she singed a waver (witch she has not) they are acting illegally. He did not say anything. And I to be honest didn’t want to face her directly as I could potentially be fired at any moment and I 0 hours temp. We are setting up a new store and it is not light work she looked ill by the end of the day. Im very worried about my employer for many reasons mostly health and safety aspects (I was told to throw a metal box above my head ‘like basket ball’ to get it on the top shelf in the store room. Im not just having a rant I want to know if there is anything that can be done about this 14 hour plus shifts idea the girl is only young and I feel she is being taken advantage of. Remember this was the area manger doing this to her tho. And we have no HR and not allowed to join a union. (Part of the contract emplanes this will result in instant dismissal)

When I worked 12 hours shifts i got half hour in the morning an hour at dinner and half an hour at tea time.
I was a student so wasnt getting paid but other members of staff were not paid for these breaks.
On 14 hours I would have thought the breaks would have added up to two hours the same as i got.:j0 -
It is illegal to ban employees contractually from joining a union. So that tells you everything you need to know about your employer.0

You can sign out of the 48 hour working week, but that doesnt mean you withdraw your claim to legal requirements on rest breaks?
How young in the employee? Was she required to come back to work the next morning? How much rest period between shifts.
Is this the type of employer who puts you on a salary then expects you to do a 60 hour week with no overtime putting net hourly pay to about £4 an hour?0 -
thats intresting can they refuse to employe you or withdraw a offer of work if u are part of a union?
If they explicitly state this - i.e. you can prove it - no. The right to join a union - or not to - is a fundamental right in the UK and a personal right. That means it is your choice, not an employers.0 -
Rest breaks - a break during your working day
As an adult worker (over 18), you will normally have the right to a 20 minute rest break if you are expected to work more than six hours at a stretch.
A lunch or coffee break can count as your rest break. Additional breaks might be given by your contract of employment. There is no statutory right to 'smoking breaks'.
The requirements are:- the break must be in one block
- it cannot be taken off one end of the working day - it must be somewhere in the middle
- you are allowed to spend it away from the place on your employer's premises where you work
- your employer can say when the break must be taken, as long as it meets these conditions
If you are an adult worker you have the right to a break of at least 11 hours between working days. This means as an adult worker, if you finish work at 8.00 pm on Monday you should not start work until 7.00 am on Tuesday.
Weekly rest - the 'weekend'
If you are an adult worker you have the right to either:- an uninterrupted 24 hours clear of work each week
- an uninterrupted 48 hours clear each fortnight

It is illegal to ban employees contractually from joining a union. So that tells you everything you need to know about your employer.
And add this from GMB FAQ
If your employer penalises you for joining a trade union - whether by dismissing you or through lesser discipline or other detrimental treatment - you can complain to an Employment Tribunal. Compensation levels for union victimisation dismissals are higher than normal.

You do not need to have one year’s continuous employment before brining a claim for unfair dismissal if you are dismissed because of your union membership or because you joined in your union’s activities.
I think it utterly disgusting that employers treat people like this- yes these are hard times but that doesn't mean people should give up their employee rights for the sake of a job."It's nice to be important but it's more important to be nice." :T0
