Shop in the country

Does anyone know if a country shop is legally allowed to burn rubbish at the rear of their shop?

    I think it would depend on the council's bye laws.

    You could call the Environmental Health dept and speak to an Environmental Health Officer and pick their brains. They will keep your details confidential so if they do go to make an inspection nobody will know who prompted their attention.

    I would have thought it would depend if it was a 'smokeless' area (ie domestic solid fuel) - if it's not, and most rural areas aren't, then it's probably ok. (Personal opinion only - no basis whatsoever in law).
  • No:

    a) Produces black /dark smoke (not allowed under Clean Air (Northern Ireland) Order 1981); and
    b) Breach of lots of environmental regs for disposing of waste in this way - there is a legal obligation to dispose of waste properly and it does not include burning!
