Hi all
I have a credit card that is up to and just over the limit with the charges the company has put on ( nationwide) My wages and my wifes have gone down about £400 a month and we cannot afford to pay the minimum ammount. I have sent them a budget plan that i filled in through the national debt line, the amount i had to offer was a token payment of only £10 per month hoping that they would freeze interest and charges. They have refused to do this, but i pay it through direct debit anyway . They say they can only accept two point something percent that works out at about £95 per month . I am now on the eighth phone call from them ( over the last 3 weeks) asking why i dont pay and each time they say they cannot accept my offer . Each month i get a fine of £12 plus the interest and charges keep going up as i am now well over my credit card limit . any advice welcomed please am at my wits end

Hi Steve,
Unfortunately some companies still feel the need to bully and harass people into paying more than they can afford. You should try contacting them again and explain the situation in the hope that some of them listen, but don't be surprised if they don't! If they do not freeze the interest, they will probably sell it on to a debt collection agency soon and the interest/charges will eventually stop. Regarding the phone calls, don't go through the security check with them, tell them you only wish to be contacted in writing and send the letter below.

I am writing in relation to the quantity and frequency of telephone calls that I have received from your company, which I deem to be personally harassing. I have verbally requested that these stop, but I am still receiving calls and I now require all further correspondence from your company to be made in writing only. I am of the view that your continued harassment of me by telephone puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997.
If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine. Be advised that any further telephone calls from your company may be recorded and used in evidence and I expect this harassment to cease immediately.
