Nearly at bailiff/court stage

Hi, I've been pretty stupid. I got myself into debt and tried to sort out payment plans with the various companies I owed money to. Some agreed, others have acted as if they've not received any correspondence from me whatsoever. I'm now at the stage where I have been threatened with Bailiffs coming round and lots of "letters before action". The debts are all in my name, I am now in full time education again and am living off about £300 a month from my part time job and £80 a week housekeeping from my OH. I would not expect his to pay my debts although he has offered to help I don't see why he should and he has his own finances to worry about. My question is, if I do something like Payplan, is my partners wage taken into account too? If yes, what if we split up? Any help greatly appreciated. Thanks

Hi littlerascalz and welcome to DFW - lots of questions in your post, but you have come to the right place, and , by the look of it, at the right time.
You really need to post a full SOA - Statement of Affairs - to get the best advice, but for the moment:
    1. No-one can send the bailiffs in without a CCJ - you say that you have received 'letters before action' - normally these are just that and if ytou don't reply, they could take you to court. If they do this you will receive a summons, and you would have the chance to make an offer of payment - even after a CCJ has been obtained, you would STILL have the chance to make an offer of payment, before the Bailiffs were ledt loose on you.
    2. If the debts are all in your name, then they can not touch your OH, or his property. Beware, however, not to have any joint accounts, or credit cards, that could financially link you.
    3. Payplan, or CCCS or CAB is an excellent idea.
I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

rog2 you seem very helpful with these matters, you was very helpful to me

littlerascalz it was the best thing ive ever done contacting payplan, they are trained to be nice (well thats what i think lol) and will def help you. they will tell you the best option depending on your circumstances.

one thing i would suggest is from what ive read on here payplan are quicker to have your chat with you than cccs but thats only what ive read etc
  • Thank you, that's very helpful advice. Am going to contact Payplan asap and get my SOA posted on here. Will I have to include what my partner earns?

    Thanks
