Student loans company/debt collectors advice

I'm not sure if I'm posting this in the correct section, if not then appologies.

Anyway, I'm looking for a bit of advice about a situation I have suddenly found myself in.
I received a phonecall for the Student loans company (Scotland) about 4 weeks ago, where this chap told me he'd phoned to ask about my defferment form and to inform me that they hadn't received it yet. It turned out they'd been sending my stuff to my old address, the guy appologised and said he'd send one straight out. I never really gave it another thought until today when an unstamped envelope was in me letterbox when I came home from work, it turned out to be a debt collection agency visiting on behalf of the student loans company. I tried phoning them but couldn't get through.
I phoned the student loans company to try and sort it out (pay whatever it was I was due if need be), and they told me that they couldn't take the debt back once it had been passed on. I pointed out that they had never asked me for money, and thus it was a bit out of order to go selling a debt to an agency costing me money and more.
Does anyone know who I can go to to get this sorted out fast. I have no problem paying the SLC anything I'm due, I just don't want to deal with a debt collection agency or incur their fees and get any damage doen to my credit history repaired. I can hardly believe that's legal to do, they don'y even deny getting my address wrong or having my correct phone number and not bothering to phone me apart from once where they never mentioned that I was in arrears.

  • This is for an old stlye loan, I'm aleady paying a new style one out of my wages.
    I'm needing to find out who to talk to to get the loan company to call off the debt collectors before they return, take my debt back from them, remove any charges that have been added and repair my credit history. Or any other suggestions on how to tackle this. It simply cannot be legal to refer someone to a debt agency without contacting them first- they did send letters to the wrong address (or so they say) but they definitely had my correct phone number and indeed phoned me a few weeks ago and never mentioned that I was due them money.

    SLC don't usually sell debts on for collection. Just get a collector to act on their behalf instead.

    They did that with one of mine. After giving SLC hell, they took it back.

    I would write a formal letter of complaint to the SLC and send by recorded delivery.

    You contacted them and the problem was being dealt with but was passed to a DCA instead of them sending you out the defferment form.

    Not being able to take it back once it has been passed to a DCA is missinformation. The person you spoke to may not have the power to do this, but SLC certainly do. They are the client of the DCA. I would make this an official complaint and demand to know whay you have been given the wrong information, why they did not contact you and why you have still not received your defferment forms.

    I didn't think they sold debts either, but there was a hand delivered card fron a debt collection agency (resolvecall ltd. Glasgow - I live in Nottingham now but I assume they have an office here), and that worries. Why would they go to the effort of sending somebody to my house? My previous defferment can only have run out a few months ago (I'm not sure when, I don't keep track of these things, it maybe as much as 6 months), so it's not a vast amount of money and it isn't that long overdue (infact I haven't yet been asked for it or know how much it is). I assume if the collector was acting on behalf of th SLC they would receive a fee for their efforts, then why go to the expense of sending a guy to my house before writing a letter or phoning me? I doesn't make sense to me, none of it does!

    Any advice on what to do if the debt collectors come back before I get this sorted? I have no real idea what my rights are. Am I allowed to tell them to !!!!!! off? Will I be charged £xxx.xx for their visit and subsequent ones etc.

    If it is a debt collector, then they have no legal powers. If you ask them to leave and they refuse, they are trespassing. They have as much legal power as the paper boy. They can ask yo to pay, but that's as far as it goes - they are not court appointed bailiffs.

    Tell them to go away if they come to your door and get that complaint letter sent off asap.
