Is this legal

I have a personal loan which for 3 and a half years I have paid by standing order. The bank allowed me 5 days of grace on the payment date ( due on the 10th but I had until up to the 15th of each month to make sure funds were in my account.)
Last week I received a letter telling me they were changing the payment method to a direct debit instead meaning if funds were not in on the 10th I would get a bank charge.
Can they legally do this does anyone one know as I never gave my permission for a direct debit to be set up.

  • i`m sure they can ask,not sure they can insist,but most payments now are D/D.
    Just request the d/d date be the 15th is all i can suggest.

    At the end of the day, this will be on your loan agreement. They can choose whichever payment vehicle they like, so long as it meets the date on your loan agreement. As woodbine has said, it may be an idea to call them to ask them if they will amend the date for you.

    Thanks for both replies. I was told I could amend the date of the debit but I was !!!!ed off that I was" told" and not "asked" that a dd was being set up. The date really is irrelevent apart from the fact that it was a case of "cant be arsed today ill go tomorrow". It was the principal of the matter but once again cheers for the advice.
