You know that if the CCA takes more than 12 days (+2 allowed for postage) to arrive, he can quite legally cease paying until such time that the document does show up?
Whether he chooses to do that is up to him, but I think it's certainly worth considering - especially if Sainsburys have been nasty enough to set a DCA onto him for no good reason when he's been consistent with his payments.0 -
I have 3 seperate debts that have gone to Moorcroft, some of which I haven't made payments on or contact with anyone about since August/September.
I called them Tuesday and said I wanted to make an offer of repayment which would be a £10 token payment this week and then £20 a month until such a time as my circumstances improve, and they ummm'd and ahhh'd and said can you do this can you do that, and honestly I found just saying well no I can do what I've offered and that's it, they eventually gave up and said they'd accept what I was offering.
Make sure they don't bully you into paying something that's not reasonable for you to manage, tell them what you can do and say it's all you can do, and it's that or nothing. If your son is unemployed they are unlikely to want to mess around trying to get more out of him.0 -
My son made the mistake of ringing them as soon as he received the first letter - it wasn't a very satisfactory conversation - they were not interested in a monthly repayment plan but were trying to set up a settlement. I had offered to help but could only raise just less than 50% - they didn't want to know when he mentioned it. However their attitude was really a blessing in disguise. It was only panic which made him ring but he knows now that we are receiving good advice so we are just going to take one step at a time and everything will be done in writing. Like you he can't afford to pay a large amount every month and he wont do anything now without talking to me. Thanks for your comments.0

Just do as suggested and see what they send (if anything)
They only pay around 10-15p in the pound for these accounts, so any settement offer over that and they are making a profit!!

May I just ask something please, along similar lines, but, I'm much further forward in my proceedings with Moorcroft than the Lady who originally posted.
I've been unemployed for about 12 months now, I registered with the CAB, last December, who sent all the relevant documentation and contacted Moorcroft's, and all my other 5 creditors, with the same information regarding my ability to pay what was owed on a monthly basis having completed one of their standard income expenditure forms. I spoke to Moorcroft's who said that my account would be reviewed every six months, and proceeded to pay them £10 every month. I had a phone call at the beginning of June 2010 and informed them that my details hadn't changed and I would carry on paying the stated amount every month, which I did. I had another telephone call from them on Friday, early evening, stating that another 6 months had passed and my account was under review. I advised them that my personal circumstances still hadn't changed and I would carry on paying them the £10 every month, HOWEVER, that wasn't good enough for the woman who rang me, and she then said that after 12 months, the account had changed ( don't ask me what she meant by that ), and insisted I pay the whole amount outstanding. I asked here if she was new to my account and was aware of the last 12 months documented evidence against it. She said that there was nothing on my account and it was to be treated like any other outstanding debt. I advised her that as I was still unemployed I could only afford the £10 every month that I have been paying regularly. She demanded I increase the monthly figure and behaved so unbelievably ignorant and arrogant, I might have agreed. She refused point blank to give me her name when I requested it (politely) saying that it was aganst the law to do so. I informed here that as I have been employed in Finance circles for nearly 25 years, I knew that to be a lie, and she had to give me her name, to which she point blankly refused, so, what do I do now?
To say she bullied me is an understatement, to hear that all the work that I have done along with the Citizens Advice Bureau in setting up repaying the debt every month, to have it now nullified, is both perplexing and confusing. I obviously couldn't contact the CAB on Friday night, or, Saturday or, Sunday, so what legal rights do I have now with my account, and how do people get DCA staff's names to inform Trading Standards Agencies and the CAB as well, as I'm sure they'd want to know who I spoke to, how can I prove anything?
And as I was harrassed into agreeing with the woman to an increase in the repayment, as I didn't know what legal rights I have to challenge such a decision, and unable to contact anyone at a late evening hour, do I now have to accept it.
I'm sure there are other folks who may be in a similar situation, who need a little guidance.

iv had dealings with these idiots, tried to set up a plan with them and they refused. I have completley ignored there threats since and surprise surprise they sent me a letter saying they would accept £20 a month which is what i offered in the first place. These muppets are just sending out empty threats0
