Paid CSA - still no access

My partner's CSA payment schedule was finally sent out and my partner paid the CSA over a £1,000 in arrears plus made sure all his payments are now up to date and being paid by direct debit. This was done over 4 weeks ago.
Since then, however, his ex states she hasn't received any money and says he's lying. When my partner travelled the 200 miles to see his kids last weekend, she was out. She texted him to say that until he pays, he's not seeing the kids.
He's phoned the CSA and they say payment is still going through the process of being sent to ex.
How long do payments usually take to be sent to PWC?

    Hi

not sure of your answer but CSA does not equal contact with your/ your partner's children ie paying maintenance does not mean your partner will get access to his children. This is a separate matter to be negotiated between the parties or through the courts.

  • Unfortunately, his ex stopped the kids from staying overnight to ensure maximum maintenance payment. She lets him see them every weekend if he travels up but sometimes she's out. We are in the process of trying to organise mediation - we had an appointment booked but she didn't turn up and my partner had presents and stuff for the kids. The next step I guess is the courts but a) we don't have much money and b) are scared to venture into this area.
We thought that with the CSA payments up and running, she would give him a bit of slack with contact but she claims not to have received any money!

The opposite is also true - being in arrears or not paying child maintenance should not result in the PWC denying access.

They are two separate issues, the child has a right to know both parents and to be provided for by both parents, if one parent is remiss in one area, the other parent is not entitled to withhold the other.

Unfortunately access is deemed a court issue if there are any problems - the CSA are only about child maintenance.

From "him" paying and me receiving it normally takes about 2 weeks for the money to come through and even then it isnt always in full and can come in 2 payments. That's the CSAs fault though not my ex's.
I can't be bothered updating this anymore

She shouldn't be using money as leverage for contact with their father. That's a terrible case of "not being in the child's best interests". Please tell your husband to go to a local Families Need Father's meeting and get advise on how to represent himself and go to court for proper contact. He needs to keep the evidence showing how she is treating your Husband and, in turn, their children. Your Husband playing to her rules, is just telling her what she is doing is OK.

Is the case gone clerical perchance?

I receive my payments on the same date mostly every month now but initally it could take up to 6 weeks for a payment to filter through.

Shocking behaviour from the ex though....Mother of the Year award winging it's way to her eh? NOT

Her children are not a commodity to be used on the open market as bait...suggest you print off this thread to show to the kids when they are old enough how much their Mum valued them

Not sure what clerical means. My partner received a payment schedule with first payment including arrears which he paid in full via the post office. Set up SO from there - first monthly payment has been taken. I guess if it takes up to 6 weeks for first payment then she may not have received it yet.
I'm going to find out about the Families need Fathers. We set up and paid for mediation at request of ex and got advice from CAB but she didn't turn up.
    Thanks again.

Clerical means that an actual human being has to input data and make any changes to a case as oppose to the 'computer saying yes'!!!

I'm not saying that it will take 6 weeks, merely passing on the info that it happened to me.

You need to pin the CSA down and try to get an exact explanation of why your money is stuck in their system, they are accuring interest on it and meanwhile there are kiddies out there missing out on precious 'Dad time'.
