Charge showing on land registry

Hi

My aunt Betty died leaving a house worth £350 to her nieces and nephews including me but there is a unpaid mortgage of £280k. I've asked the mortgage company when the loan was made, etc. but they keep fobbing me off.

She was suffering with dementia and it's rumoured that she took out the mortgage recently so she may not have known exactly what she was doing. No sign of the £280k. She had several different 'helpers' living with her at various times who I can't track down. The mortgage company are demanding we sell the house asap to pay off the £280k.

The land registry entry shows a charge to the mortgage co dated Sept 2009. Does this indicate that she took out the mortgage at around this date? If it is, I have medical evidence that she was suffering with advanced dementia at the time so I think I might be able to challenge the validity of the mortgage agreement.

    Yes it is likely that a mortgage was taken out on Sept 2009 if there is a charge on the land registry for that date. It will probably tell you the lender as well.

    Who is the executor of the will ? Once properly notified, the banks should co-operate with the executor and deal with them as though they were the deceased person.

    They need to be looking closely at bank statements to establish where this money came from and went to. You are suggesting that there could be a criminal element to this, which needs to be properly investigated
