Does token payment count with 6 year rule?

I just found out about this 6 year debt rule so I'm wondering if I've been making a token payment of £1 sine 2003 does this count as contact.

I have a few debts where I was making token payments and the other day I received a statement from a company saying I was £13 in credit so I called to find out who it was and they said my debt for a loan I'd taken in 2002 was now clear when I thought I still owed about £600. So I'm guessing the 6 year rule applied here possibly. I last contacted them in 2004/5 I think but the £1 was already in place.

I've had correspondence recently from another debt agency chasing a credit card debt from the same time, I moved address in 2006 so haven't heard from them till now but wondered will the rule apply here? I haven't acknowledged the letter

    If you are making even token payments then the six year period hasn't even started.
  • In order for debts to be statute barred, you can't have made any payments or even acknowledged to the company in question that the debt was yours for the past six years.

    If you have been making any kind of payment at all, the clock won't have started.

    It might be worth asking for a statement of your payments against the debt to see what has happened, as you don't really want a nasty surprise later. :-/
