Credit fraud.
Hi there,
Im after some advice regarding fraudulently taking out credit (with a catalogue (shop direct)) in somebody else's name?
The situation is this: My g/f mum spent £500 on an account that had been closed by my g/f a while ago. The mother reopened the account without permission with the intention of paying it off.
We found out about the debt when we applied for a mortgage and got refused due to a default on her credit file. There has been plenty of contact between Lowells (debt collection agency) and my g/f and we have spoken to the ombudsman.
Basically what i would like to ask is what would be the legal consequences if the mother owned up and paid the debt off and would we get the default removed?!
Obviously I dont want to get the future mother in law in bother however we kinda really would like to buy a house and cant with the default
Any help or comments are greatly appreciated.

I would have thought the only way to get it removed from your GF files would be the fraud route,then lend or give the future MIL the money to settle debt.0

She will have to declare that she comitted fraud, the lender may or may not prosecute0

I'd report your future MIL to the cops. She had no intention of asking her daughters permission before doing what she did.Never Knowingly Understood.

Cheers for the advice everyone! Just a quick update, spoke to shop direct (original creditor) and they seem to think they can buy back the debt from lowells and seen as they finally might have realised it wasnt my g/f who took the credit out were very helpful. They suggested that we could open a 'family dispute' case and pay on behalf of the mother (she is paying and has the money) that way no names need to be mentioned. They also said that the default should be removed but could take upto 4 weeks, which we don't mind so long as its gone!!
They should be sending it all out in writing. Thank you again for the comments, hopefully next time ill be able to post that the default has gone, gone, gone!!!0 -
Wait until they send it by writing until you think you're out of the woods. And give your future MIL a right good talking to!
