Reclaiming charges and requesting CCA whilst on DMP?

Hi all
After a tough few months I have entered a DMP with CCCS. My payments at the moment will be low until I start a new job in January and already MBNA have said they will not accept it and will sell the debt on although they have stopped interest and charges. I have not heard from the other creditors yet.

Most of these debts are pre 2007 so I was thinking of reclaiming charges and maybe taking a look at the CCA's. Would this in anyway jeapodise my DMP though? I don't want to rock the boat or p*** any of them off really and lately they have all been pretty reasonable.

  • Hello - Noticed this thread with interest. I have now started my DMP and seem to be getting on ok. Although MBNA being bit difficult now - sending threatening style letters !!

    I have been thinking about now writing to all creditors and asking for refunds of charges (particularly credit cards & bank charges) and wondering does anybody have experience of this whilst on DMP. I would obviously be claiming hardship. I am just thinking that if they refund some charges they would in essence be reducing the debt owed to them. I wouldn't want the money in my hand and would be happy just to reduce owed amounts.. Any experienced views very welcome. RON

    You have a legal right to request a copy of the CCA at any time. It is if you stop making payment that they will probably get the hump. How do they know you are not just keeping your records up to date?

    If you are entitled to reclaim charges, then they should not punish you for doing so. You would be better looking at the reclaiming boards for more indepth discussion on this though. Any monies that were due to you from charges would probably be applied to the balance owed. Same with PPI if you were in arrears i believe.
