Sick leave over but still not fit for work - what happens?

  • Well, I am under the impression then that the company my husband worked for has breached the DDA. All through his treatment told him that his job was safe, he even went and bought a new scooter to get to work (so now in debt) and then told him they didnt have another job for him (he didnt want another job he wanted his own job). They never asked him if he needed any help or adjustments, he went to occy health and the report said no "no heavy lifting for the foreseable future". There are other people there who would have helped with any heavy lifting , (and this would have been their reasonable adjustment). They said if you cannot come back doing 100% of the job you cant come back at all.

    For the OP was the person driving the car that him insured? The compensation he receives should take into account loss of earnings both current and future if he is unable to return to his previous occupation. Some insurance companies offer interim payments where there is a case of hardship so he should speak to the solicitor dealing with the case. If he has a senior level job there may be something in his contract about a long term sickness scheme that pays a percentage of his wage, which he would receive on top of the ESA - this is something he should speak to his union about. Does he have a policy to cover his mortgage if he's off sick? Are there other areas he can cut back on -can his season ticket for work travel be cashed in/ a car sold etc?


    The other driver was insured but the case hasn't gone to court yet, although hopefully it will soon. Lots of helpful advice from posters here which I will pass on to my bro - thx for all taking the time to reply.
